			<description><![CDATA[<p>The Pretrial Fairness Act abolishes cash bail and provides for a presumption in favor of release for misdemeanors, traffic offenses and other petty offenses, provided a defendant is not deemed a risk to the community by the arresting officer.<br /><br />Never was arrested so I don&#x27;t know the pretrial process or how the bail amount is determined. I know of a woman that lost her house when you used it as collateral to bail out her son. He was arrested on drug related changes, missed several court dates, and the bail bondsman had no other choice.<br /><br />One of the primary goals of the law is to make sure that we&#x27;re having in-depth, detailed hearings when we&#x27;re taking away someone&#x27;s freedom<br /><br />Interesting law, because pretrial incarceration there is a presumption of guilt especially for misdemeanors. Many people spent time in jail and later were found not guilty.<br /><br />Maybe someone here had experience and can explain the process from arrest to arraignment, pretrial bail hearing, and how long someone that couldn&#x27;t post bail was in jail.... &#x5b;&#xa0;<a href="/blogentry/173543">More</a>&#xa0;&#x5d;</p>]]></description>
