			<description><![CDATA[<p>&#x3c;br /&#x3e;I don&#x27;t know if this is a Federal or State law but I was told that it&#x27;s against the law for the doctor or laboratory to notify the employer of the test results before contacting the applicant for a reasonable explanation, so I&#x27;m not sure where you get &#x22;you are not given the opportunity to prove the result.&#x22; I admit that since I don&#x27;t smoke dope or snort coke, I don&#x27;t give it much thought. 			<description><![CDATA[<p>time*treat&#x27;s says it well.&#xa0; &#xa0;An issue in this life that I have extremely strong opinion about based on professional experience.&#xa0; &#xa0;Career, family and life has been destroyed because of false-positive results of drug testing - especially the now all-too-often encountered required testing for employment.&#xa0; &#xa0;I have absolutely no problem with an employer or law enforcement requiring knowledge of an individual&#x27;s use of an illegal substance or, in some cases, a legal substance, especially when the use of said substance might bring harm to others.&#xa0; &#xa0;The problem is how flawed the testing itself can be and how many variables can affect the outcome.  The average layperson is neither informed nor in a position to know before they test that they could fail before they even begin.&#xa0; &#xa0;This is not urban legend.  Innocent, law-abiding individuals are being flagged every day for &#x22;failed&#x22; drug screening and the key here is not why you failed but that you did fail - because that&#x27;s where the attention span of employers, law enforcement and  the general public all too often stops.&#xa0; &#xa0;List most medical information, facilities which do this testing routinely computerize all medical information, especially test results - yet another reason for caution.&#xa0; &#xa0;Say you apply for a job and, despite knowing it cannot be true, you fail a drug screening test.&#xa0; &#xa0;You are not given the opportunity to prove the result is false and you do not have the resources or time to fight the injustice.  You do not get the job.  End of story - not!  Your &#x22;failure&#x22; is now a matter of record.&#xa0; &#xa0;Hopefully, that record won&#x27;t be spashed in the face of the world as a media headline.&#xa0; &#xa0;Guilty or not of failing the test, this woman will now have this mark on her career and life forever.... &#x5b;&#xa0;<a href="/blogentry/19591#c18916">More</a>&#xa0;&#x5d;</p>]]></description>
