In this case, it seems that his arms were up and he was FACING THE OFFICER after he knew he wasn't going to get away. Makes no sense, to me, that he'd start walking towards the officer after being shot...which also corroborates the witness' statements about hands up. This is gonna get real ugly... I can see it coming.
