In the light of this new information and If the policy or practice is proven/verified to exist and it had ever been deployed forward, then the employee who sold the rejected thickets must be subjugated and required to buy the unpaid tickets - per policy, and this employee may have a claim level to the tickets that is higher than Circle K's.

I should have thought of it before hitting post but here's another huge red flag. If the guy was following company policy and not trying to be dishonest or hide his actions why is he sharing with Ybarra? What is it about buying the tickets in compliance with a company policy that made him give away half of the money?

Also the earlier post should have said temporarily suspend .

Gawlitza s attorney, Josh Kolsrud, said Circle K had an unofficial policy requiring employees to buy accidentally printed lottery tickets valued over $20 a measure used to penalize workers for the accidental prints.

If Kim purchased the first 60 dollars worth of tickets then, look at the serial number on winning ticket to see if its part of the first 60 tickets, if so she is the rightful owner, if not the ticket still belongs to the employees because the original ticket holder chose to continue without the purchase.

yeah, it's a slow drip of new facts every week, new facts that change the picture.

first it was the lady didn't have enough money to buy all the tickets, now it's that some of the tickets fell behind the counter and maybe nobody noticed?

first it was just this dude gawlitza trying claim the ticket, now there's this other chick ybarra who actually signed it. which makes no sense at all.

If Circle K thinks and believes as you have reasoned, I see no reasons why they would not have presented the thicket for payment and call it a day.

Because they have a better grasp of things than you do. Somebody else signed the ticket and another person has seemingly asserted a claim. Even if you're acting in good faith it's problematic to file a claim with a ticket when you know others are asserting ownership.

What's the big deal about being the rightful winner.

Correct me if I'm wrong but last I heard, rules states that if there's MULTIPLE winners of a Jackpot, they evenly split the winnings between them.

I would not reduce the clerk's actions to incompetence . The clerk is experienced but is human.

Soonchun Kim left, because they was insufficient fund in her account to cover the purchase.

I think soon-kim intended to purchase all the tickets.. soon-kim used a debit card to purchase. The article said some of the tickets fell behind the printer, mabye the clerks incompetence caused soon-kim to leave with less tickets.

However,

She purchased a batch of lottery tickets and did not make sure she had the money to cover it BEFORE she made the purchase.....

(UNLESS changes are made for the better, how a person manages money before a win is a clear indication of how they will manage it afterward one.

Upside: your claim is just as good as Kim's or Ybarra 's.

Downside: in this case just as good means not even a snowball's chance in hell.

why did she sign the ticket either before or after selling it to gawlitza?

Common sense says that either she's a moron or she knew what was going on when Gawlitza wanted to buy tickets after the drawing. Maybe she's not a moron and it was her attempt to get a share of anything Gawlitza got.

Ybarra's signing of the ticket suggests and supports the existence of an agreement with Gawlitza. The agreement is a nullity.

If, it is determined that Soonchun Kim had caused the winning ticket to be generated, I think she deserves a fair chance and I mean get the whole prize - so long as she pays for all other tickets generated in her name that she did not pay for due to insufficient funds in her account.

oh wow, a new scammer character is introduced. why did she sign the ticket either before or after selling it to gawlitza? why did gawlitza try to claim something with her signature on it and not his? did they not know the claimant has to be the one to sign the ticket??? judge ain't gonna rule in favor of either of these two.
