Qualified immunity or not, do you really believe police would arrest someone for selling drugs just because they had a stack of $20s and were buying $400 worth of Cash-3 lotto tickets ?

And the cops can't even detain people without reasonable articulable suspicion, can't legally search the person without a warrant, and the person does has the Right to remain silent. I'm pretty sure Brock Lee said it best, it is fun to pretend to believe it .

Sue the lowlife snitch store clerk for the lost time and emotional distress he/she caused you.

Boycott the store.

If the snitch was motivated by financial incentives from a police state, sue the police state.

If you live in a place that doesn't take a daily dump on your individual rights, then there are probable cause requirements for arrest. If they had no probable cause (snitch conjecture is not probable cause), then sue the organization that arrested you.

Qualified Immunity for police is not a defense in all states. More importantly, it does not apply if a constitutional right was violated. If the arrested individual was a minority or other protected category and could prove in court that they were targeted, qualified immunity would not be a defense.

We all see police court trials all the time for police misconduct.

I've heard of people being arrested not because they wanted to buy a lot of tickets but for cashing in too many winning tickets. There were some guys in Massachusetts that were successfully prosecuted for buying a huge amount of winners cheaply from people that originally bought the tickets and then cashing them in. G5

You said you were arrested apparently for the crime of having a stack of 20s . Your lottery probably retains legal council, but doubt they are responsible for the arrest or will represent you if you decide to sue for a number of reasons.

Should have filmed it and posted it on YouTube.

And BTW, A recent series of articles by The Washington Post chronicling the issue found that of the 400 court cases examined by The Post where people who challenged seizures and received money back

I once went into a store I go to regularly to get tickets and was told I had to wait because a guy asked for 1,000 tickets and the printer was going nonstop. Needless to say, I went to another store. I don't think anyone was arrested or anything like that.

In the last link the charges were probably failure to cooperate. That could go if the guy had been flaunting his stack while insisting he was a paying customer and would take as long as he liked to pick the tickets he wanted when other customers were waiting. Like....

I gave my bank contact information to show that I withdrew more than $400.00. Otherwise, I would not had received my confiscated money returned. Remember there is a civil asset forfeture law that the police department can use to keep my money if l can't prove that it belongs to me.

Looks like you never heard of the Fourth and Fifth Amendments to the United States Constitution. Unless they have priors, I'm pretty sure the police are not interested in investigating someone with a stack of $20s with no evidence of a crime based on concerns of Karen the store clerk .

Good. Glad you followed through. The lottery should at least paid your attorney fees and disciplined the store owner. Perhaps revoke his right to sell tickets for a month. I would go back to the store and dare them to try it again. Lol

I did report it to the FL Lottery via legal representation. We got an apology for the incident. The store clerk was at fault. I can spend however amont of $$$ on the game of my choice. But I'll never go back to the store where I was arrested.

The store required cash as payment to buy the lottery tickets. I had a stack of $20 bills to pay for the game. Well the amount you spent on the lottery was not relevant. If the money you were spending was suspected to come from non legal sources and not income from a job, investments, etc., there was likely probable cause as to why you were under surveillance and arrested. If there was not, contact your state lottery and an attorney.

It had nothing to do with how much one spends on the lottery.

My mistake. I posted the wrong link. A few years ago, I was buying $400 worth of Cash-3 lotto tickets.
