Again, I see your point, but the problem with using a 38.6% calculation is that nobody would be actually paying that amount either. Hopefully the jackpot winner would have enough sense to hire a good accountant and tax attorney in order to minimize the tax burden. -Todd

Since Lottery winnings are considered along with normal income it falls under the regular Federal Tax Laws. So if you win a lottery and take the cash amount you are figuring your taxes for that year if earnings (both regular income and lottery income) exceed $302,050.00 you fall into the highest tax bracket for income which is 38.6% under current tax tables. If the lottery earnings are taken at the annuity level you divide the amount by 26. That is the amount you are taxed on for that year. Fede... [ More ]

Dennis,That's a good point, that the taxes withheld by the lottery are not necessarily what the final result will be. I put that in a note at the bottom of the page.Where did you get the 38.6% number from? Is it just some number you threw out there, or did you actually see some kind of statistic on it? My thinking is that if there is some more realistic average number that I could apply, then I could show the 27% that they are mandated to take out, and then maybe a realistic number based on an... [ More ]

ToddNice addition to the site, however if an individual takes the lump sum let's be perfectly honest the tax for federal is more like 38.6% vice 27%. The Lottery Commission does not take out the proper taxes, which will leave people to believe that only 27% is all the tax that has to be paid. This is a bad practice.
