  Counselor, the NYS Lottery commission, which is governed by the NYS legislation and the rules set forth has a different way to deal with the scratch offs. 

   

  Let's say for a scratch off game they print 20 million tickets. Their are over 17 thousand retailers throughout NYS that are authorized sellers. Every business orders games. The have books of scratch offs opened to sell and some behind the counter waiting for them to open them. When a book is opened for sale from that day until 45 days later the retailer has 45 days to pay for the book minus prizes they paid out minus their 6 % they make. If that business goes out of business, bankrupt, sells to some else, transfers ownership or just closes for good or even a few months for lets say an over haul ALL opened books of scratch offs If that business passes the 45 day mark and they do not want to lat out the money for an open book, because it is taking too long to sell they can send it back, or if the representative thinks that book has been sitting too long can send th open book back, or the tickets cannot be scratched the book goes back. ALL opened books sent back GET DESTROYED. 

   

  That means that if their is a winner in that group it got destroyed. I want to know why with 6 NYS lotto customer service centers and 15 including the casino customer service centers why these 15 locations cannot sell books that are sent back. They have to stop a game from sales if and when all 1st prize tickets are claimed but if the ticket got destroyed they can keep selling th game and thy get to keep saying their is one winner left even though that one winning ticket got destroyed. So in reality we are chasing a dream that cannot be possible to happen since the ticket got destroyed. So I want to know if we can get NYS legislation to accommodate these open books so that they can still be sold instead of destroyed. It is almost like legalized fraud they are committing. 

   

  Not to mention that tickets get robbed and stolen but that amount is nothing compared to the amount of tickets that get destroyed. Do we have a case.

  not a lawyer but like the way Pennsylvania handles this at least when it comes to transferring ownership - before any store is sold they must sell through all their existing scratch off inventory - happened when i was down there about a year ago and they had almost no scratch offs left and they said they were selling the store so they have to sell off their inventory before the new owner can take over
  
  still think the answer is no but would like an actual lawyer to comment

  If their is an attorney that could just comment on what the law is. I think that in a court of law it would have to come out that it is unfair advantage to the public that the tickets are getting destroyed.

  A few things that can be done:

   

  Since they claim the policies are that of NYS legislators you can petition your local rep to try and change the law. The down side is that the current policy helps them sell more tickets because there is a false sense of remaining jackpots and I have never meant a politician that doesn't like money.

   

  Start an online petition and gather signatures.

   

  Try and get an organization that believes in fair gambling practices and educating consumers involved. They may have lawyers that are willing to start a class action lawsuit against the NYS Lottery. There are a lot of shady things they are doing that will come to light in a lawsuit. Including but not limited to jackpot spacing and placement, purposely keeping gamblers under informed and combining different series of the same game title (sometimes they even have different odds).

   

  I know for a fact that they not only give away tickets during street fairs and other events, but when they started the last run of for life games they gave away $2,500 a week for life tickets as part of the second chance sweepstakes. There was also an upstate news paper that gave tickets away.

  yes they do that a lot - give away tickets out of the latest 5 dollar games - got $40 for free once - think there were a few $100 tickets won too but of course u have to buy other games to get the free ones

  You know what I like the petition idea. if and IF is a big word., we can get 100,000 people to sign it would force the president of the U.S. to look into the matter which could get the NYS legislation to do something about it.

  true but they were successful about building the death star from star wars and deporting justin bieber so not that sure about lotto tho but would like to see one started

  have not ever touched that game and not going to start now - have never won on a $30 ticket in fact and have played them in other states

  I've never been a fan of scratch offs, and I don't normally buy them.  There's a reason for that.

  I heard a story about a guy who had bought a scratch off but did not immediately scratch the ticket after he bought it.  I was told that he didn't scratch it for at least six months or possibly longer.  That's because he bought it and put it in the glove compartment of his car, but completely forgot it was in there.  He rode around with it in his car for at least six months before he opened the glove compartment and saw it.  Apparently it was the last top prize winner for that scratch off. Because the state lottery did not know that it had been sold, as it had not been claimed, the state lottery did not instruct retailers to pull the tickets, and stores went on selling that particular scratch off even though the top prize was impossible to win. 

  I've no idea if the story is true or not, but it's certainly plausible and could happen. The guy who told me the story also said he never buys any scratch offs except those that have been recently introduced.  According to him "It's a pretty safe bet all of the top prizes are still available."

  The president isn't going to get involved in what is obviously a state matter. He has bigger fish to fry.

  I would recommend contacting both your NY state senator and representative in writing. If you believe there's something illegal occurring, contact the NY state attorney general's office.
