To the NYS Legislative and Investigatory agencies,
I a filing an official complaint against the NYS Lottery division and its distribution center GTECH. For the purposes of this complaint I am going to refer to NYS Scratch off game # 596 1 million a year for life as an example but it is for all games.
NYS Lottery started game 596 in Sept of 2008. This game had 6 tops prize and 50 2nd prize winners. The end of game was called for this game for August 11, 2016, that is 8 months away (240 days approx.). The game still has 1 (ONE) top prize remaining so the retailers are allowed to sell any tickets they have left BUT there are no more tickets in the distribution center to give to the retailers anymore. BUT whatever the retailers have left they are selling, can sell and should be selling until they either sell them or the game is over, in August 11, 2016.
Last week I called out to 250 stores across Brooklyn and Staten Island to see who had tickets left. I made a list and I set out today to go buy some. I had 5000 dollars in my pocket to spend on buying tickets. After all there is still 1 top prize and 9 2nd prize winners left so I said why not. I had spoken to retailer #96802 Viraj Grocery 280 Morningstar RD 10303. I knew he had a full book that he still had and I told him I was going to come in and buy the entire book for $1500.
The owner told me that last week the agent for the area came in from the distribution center and told him “That the game was over and that any unopened books needed to be returned.” So he returned the book. I heard this from 3 different retailers today. I had heard during the summer from retailers in Huntington LI that the agents were taking back books BUT I assumed they were redistributing them to other businesses because they were unopened. So I called GTECH to ask where they redistributed the books from Staten Island. To my horror I spoke with Doreen from GTECH at 800-678-7457 and discovered that these books are being destroyed. I was horrified.
So not only does NYS Lottery and GTECH destroy ALL opened books of scratch offs from retailers that go out of business, that file chapter 11, that sell their businesses, that change ownership, that send back open books because they do not want them or cannot sell them fast enough BUT now I find out that agents are arbitrarily going around since July taking full closed books back and destroying them also.
This is a crime, it is absurd and it is a <snip> shame. At the very least it calls into question the validity of the games. How do we know that the last remaining ticket is not in the books that are currently being taken back and destroyed, let alone they that it could have been in the open books that were destroyed all of these years. This is a horrible policy, it is uncalled for and it brings into question the validity of the game that is still being sold until August of 2016.
How dare NYS Lottery and GTECH deprive the players of these games the opportunity to play and possibility win if they are going to destroy tickets and now they are doing it at random. This needs to be investigated and it needs to be addressed and changed. It has really caused huge suspicion amongst the players that NYS lottery has deprived us, the players, of a fair chance to win.
I had suggested many times that ALL unsold scratch offs could be filtered through the Resorts Casino in ozone park Queens because they move tickets so fast that accounting and accountability would be so easy and so fast to handle without the wait to sell them off. Resorts recently sold 24 separate slots on their Lottery vending machines, in 2 weeks’ time. That is 1200 $30 tickets in 2 weeks sold out. Why do tickets have to be destroyed at all? Why are tickets being destroyed by NYS Lottery? I was told that it is because it is too complicated for them to track tickets that are returned by retailers for the many reasons stated and I say that is all lies. They can be sold in the Ozone Park casinos so fast accounting would be too easy to track.
I am demanding an investigation, I am asking for the proper committees to set up hearings on this matter and I am asking the powers that be to address this situation immediately. This is causing many people to mistrust the NYS Lottery division by their antics of destroying tickets. And their answer to me was well the ticket could be in the washed jeans that someone forgot to take out. That is not for them to decide. They are supposed to be impartial and not taking sides and yet they seem to be tipping the odds in their favor by destroying tickets and possibly have destroyed the last remaining top prize and we will never have the chance to win because they did this. And I was told that there is no way to know where the ticket is or if it was destroyed. I believe they do not want to release that information because they know what the answer will be.
This practice needs to be stopped and the NYS Lottery needs to be honest and upfront with their supporters. I am dismayed and upset that they removed books from retailers and destroyed them while lying to these retailers that the game was over. IT IS NOT OVER. They just do not have any more tickets to distribute out but the tickets that are left can be sold until August 11, 2016 but lottery is not even allowing that.
It is almost like they are trying to tip the game so the last remaining prize definitely does not get claimed and that is fraud outright fraud.

well according to my calculations there were 85 2nd prizes at the start of the game and u have 1 of them
good luck on trying to find out the truth sam - but unopened books should only be destroyed in the event that the last top prize has been claimed -
I was personally contacted by an upstate assemblyman who personally wrote me that he was going to look into this matter and see if this was really happening

It is possible that the NY Lottery Commission and GTECH does know where the final winning $1 million ticket is located, [i.e., which numbered ticket deck , issued to which retailer, and where] [You cannot always believe that "they don't know" just b/c they say so] [random distribution ], and they have started destroying other rolls of scratch offs to wind the game down as quickly as possible, sooner than originally planned, for some reason. Maybe there is something "defective" about this particular game. [Game # 596 - $1 Million A Year for Life] [Maybe they are having a problem similar to Illinois ]
However, it is still unfair to NY consumers. They are not being allowed to purchase and win any smaller prizes remaining in the destroyed rolls of tickets, and they are still spending a lot of money trying to win the remaining $1 million ticket, thinking that it is still in circulation. If they knew it was not in circulation anymore, they presumably wouldn't continue to waste money on that particular scratch off game. [Game # 596 - $1 Million A Year For Life]

UPDATE: Today I got my second call from a NYS Senator who said he was very disturbed by my email and if it is in fact true they were going to investigate this matter. But I am also going to contact a lawyer and possibly sue to stop the removals.

This, an other shady practices, is an issue endemic to all state lotteries. While I salute your effort rgse90, I doubt much will come of it. Lotteries, like all other multi-billion-dollar businesses, are very good at wriggling their way out of corruption.
Allow me a moment to don my pretend Lottery-Rep cap and provide a fictional, if likely, response:
Dear [Senator],
The primary initiative of the [insert your favorite state] Lottery is Integrity. While we understand the issue you've raised in light of the letter received from [concerned citizen], you may rest assured that the explanation is far simpler than any nefarious conspiracy aimed at cheating players. In fact, the practice described is specifically directed at protecting the players of our great state.
As the technology available to the common consumer becomes both cheaper and more sophisticated, the Lottery must be ever-increasingly vigilant in its pursuit and investigation of potential fraud. You can see from our yearly governance reports (insert some link to lengthy reports virtually hidden somewhere), the overwhelming majority of lottery fraud cases are brought against retailers or their staff. These are the people with the most access to instant games and therefore the ones that most often attempt to compromise them. Several cases over the last [x-number] of years have proven that a book coming back to us sealed in plastic does not mean it's unadulterated. (Insert list of fraud examples.) To ensure the integrity of our games we have had to become proactive in our investigation of all manners of fraud, and indeed must recall, open and inspect some of the otherwise seemingly unopened books in the wild. The compromise inherent to the necessary process of inspection requires that the inspected tickets be destroyed (insert citation to some regulation). These investigations have reduced fraud in our state by [x-percent] over the last [some-number-of-years].

The issue which really needs to be addressed here isn't the destruction of the tickets, but rather the apparent failure to remove any destroyed prizes from the prize pool, just as if they'd been claimed. Lotteries will probably cite cost here as being prohibitive on account of how many tickets they (or their contractors) destroy, but I'd say too <snip> bad. Spend the money to expose the barcodes and scan the tickets before destroying them; the little school children the lotteries tax us for can get a few hundred grand less from their few hundred million every year.

i would be so happy to get involved in this. I run a youtube channel and have about 550 subs, a lot from new york, that are disgusted with NY states lottery. I scratch about $100 worth of tickets daily and put them on the channel. the odds on these tickets are really taking a nose dive lately. as far as the $30 tickets I had 5 stores by me that had books one day and the next day each one of them told me the same story that they were taking away. I cant find one store in queens that has them. Until 2 days ago. I found a gas station that had there $30 tickets pulled but the agent did not realize there is a vending machine tucked in the back of the store which has about 19 tickets left that I'm going to be purchasing. i will be scratching them on the channel. if you need my help the help of my subs, I'm sure they are all willing to help. They are all huge scratchers and we are fed up with this new york crap. You can check out my channel.
