Hey, thanks! This is a partial answer to a question I asked a few days ago. What makes lottery clubs, services, whatever name they are called, illegal? How can an online group get a lottery and it not be considered illegal to be a member of it. What legal terms in the by-laws or incorporation papers would make it legal?

Is it legal to hold a prize giveaway/contest for members of a private/member only club/Corparation. If the members have paid membership fees/Dues. But have not paid for a ticket for a raffle and have not paid money towards winning the prize is this legal to do, someone please help!!!!!!!!

ok Todd..whatever..but lawyers have the answers..as they are in the legal profession..unlike a layperson ....I never said they had to be on call 24 hours a day....it takes a simple phone call during business hours...so if you want the best advice on a legal issue it will take a call to the attorney to get the best advice....laymen can only think they know alot....

That is why before you do anything you get good legal AND tax advisors.My understanding (every state COULD be different, I don't know) is if you want to split up the prize like they did, you must have a prearranged agreement before you buy the lottery tickets. Which is not likely (my opinion.) I know that when I win a big prize, I plan to give my siblings and parents a chunck each (I say now around 5 percent each), again, I don't think it is 100 % legal unless you have prearanged it. Stars

LOL Jade.You find out their mailign address and send them a letter asking them to help you out with some money.Is that ok to do?? Is it Legal??Are you planning on doing this ManMeat? My opinion is that it's legal to ask, but if you don't know this person and they haven't said that they plan on giving money out to strangers, then you come off looking bad. It's not free money. Just because someone wins the lottery doesn't mean they want people to start bothering them for hand-outs.

The question was hypothetical and only pertained to private informal wagers between people who may not actually know each other, but trust enough for small bets. I was wondering if it was illegal besides tax liabilities if it were legal. I'd hate to have to deal with a bunch of forms and legal mess after finding out this and that should have been done beforehand. I suppose the amount would be the biggest factor. Thanks for the replies.

willl3,I recommend caution. With any kind of business that deals with gambling, it is very tricky legal areas to work within. It is rare that an individual with relatively small financial backing will succeed. Most people I have seen try this end up going out of business very quickly, and often at a large loss. Worse, some people have legal action taken against them, because they did not invest large sums of money in hiring lawyers to figure out all the details.

You can always looked up postal regulations on http://www.usps.com.I've looked them up in the past and found it was actually illegal to send any lottery materials through the mail. The only time it is legal is for communication between individuals and the authority which operates the lottery.My interpretation is it's probably only legal to send tickets across state lines if you are sending them direct to the lottery.PrisonerSix
