Does anybody else disagree with graduated annuities?
You might want to check on inheritance taxation with that kind of money. I understand it has been stopped for 2010 on inheritance tax. Might kick back in in 2011. From what I read the tax is pretty stiff. 50% or better I heard.

Yes, all lottery prizes go to the estate of the winner. I'm not sure I would cash in the annuity if I were dying, unless I didn't have any family at all. Usually the winner would ask a family member to claim the prize, so there would be no inheritance tax. In this case, he didn't win over $2 million so there probably won't be an inheritance tax on the money. By cashing in the annuity and losing so much money, less the taxes, his family wouldn't be left with much. I'm not passing judgment,

The annuity doesn't end with your life, the remainder of the payments is still with the annuity which is part of your estate but your heirs would have to pay a hefty inheritance tax on it. If I won an American jackpot that was large enough, I would consider the annuity payments even though my Doctors expected me to die years ago however it would be through a blind trust both to preserve anonymity and to avoid inheritance taxes. Good approach, or how about Yes I do have $40,000 from an inheritance but it is tied up with the attorney. I need $7,999 to pay the attorney fees so I can get the money released.
