You are a little behind in the IRS tax rules. The tax exempt amount was changed to in 2005 for tax year 2006 to $12,000 (not a big jump, huh?) As far as I know it's still $12,000 in 2007. Also, if the recipient of the gift has children, each of those children can receive a gift, so it's possible for a lottery winner to give away quite a bit every year to just one family. Slight clarification. The reason that it is 44,000 a year is because your

brother can give 11,000 each to you and your spouse, and his spouse

can give 11,000 each to you and your spouse. That adds up to

44,000 a year. He can't give a way more than a million in his lifetime

without triggering gift tax.

I realize we don't have all of the details. However, if this sister isn't on drugs or squandering away her savings on gambling, shopping or other irresponsible activities, I totally agree that her brother is being selfish. $12,000 is a very nice gift however. Since this is all theoretical let's do the math.

Assuming that the brother won $35 million in Texas the post tax winnings would only be 11 million. If her brother bought a $5 million dollar home he would be spending almost half the post-tax prize on a house.

Also if the brother is limiting the amount of giving to $12,000 due to Federal gift tax that applies per person. So his wife could also give $12,000 bringing the total to $24,000.
