see my earlier post.

when i run the pool with the random co-workers i make sure everyone is paid up before i purchase the tickets. no money no play they know this before i buy the tickets. when i come back from buying the tickets i photocopy all the tickets WITH a list of the owners of said tickets. that way there is NO confusion on whose tickets are whose. i also keep all purchases of my normal pool and my personal tickets seperate from each other i.e. i buy at different times and stores. i... It would depend on many things, i.e. the past history of the person, and their intent when they asked to be included on the ticket. A friend could FORGET to put in the $1 in which case I'd still share, honest mistake, or they have a habit of promising to pay something and then not in which case they're not only off the ticket but off my list of friends! I tell younger people if you want to keep a job just show up and work, fulfill your obligation, do what you said you were going to do, and you will always be employed. It is the way I was raised.

I just went back into my post to delete 1/2 of it. Too late! (got a knock at the door) I just read the other posts again and I don't want to get into a battle about contracts. I think some people are going way overboard with this whole idea. I can almost guarantee that no court would rule that this was a legal contract. People make promises to each other all the time and can't prove them.

Regarding the obligation of the ticket holder, it's true that contracts are usually bilateral, that is, 2 people make enforceable promises based on anticipated future events. (I had to memorize features of a contract for some state exams.) So if you hire someone to fix your leaky roof and promise to pay that person, you have a contract. If this person is just a collegue who you don't hang out with other then at your job then I'd say hooey! You're out! You don't owe then anything. Now if it was a close personal friend,well,then I'm sure you'd treat the situation differently.

All the people I know, for the most part are control freaks. They'll buy their own tickets. The people I have lent money, I don't hear from anymore, now in their cases it is no longer a loan, it an investment. It'll cost them to see me again. Like clients that don't pay their bills, or people that bet and don't pay the bet if they lose. MegaWinner...wasn't the movie It Could Happen To You about a policeman who after eating at a restaurant didn't have money for a tip and said to the waitress if he wins on the ticket he has on him he will split it with her? I don't think there was any money exchanged between the two parties involved, just a promise to share if the ticket won in lieu of a tip.

This doesn't really affect the premise you described, only the PS portion.

Deleted my last post based on the California ruling that RJOH posted a link to. Didn't know just how the courts might rule on that. Excellent precedent set in that case.

KY Floyd's comments are outstanding and I believe anyone in charge of a lottery pool should read them thoroughly along with having a stipulation in writing that if you don't pay to be in a particular draw then you don't participate in benefits it may yield. I do not pool, it opens up too many legal issues.

If for some strange reason I did pool, it would be with friends, and I will be willing to front them the money on a late payment.

Why would you want to pool and split winnings with someone that you clearly do not like

I really do wish more people would stop relying on verbal agreements for serious things like this. Yes! That's right! Lottery pools are very serious matters! I wouldn't share any of my winnings with someone who only had intentions of contributing to the price of ticket some time late. I would go ahead and include them and forgot about the dollar if they don't pay me because I don't want any trouble. Typically how humans are or at least the ones i know, will nag me and tell everyone else at work and in town what i did and how wrong i was and win those people to their side and I will then have the whole town nagging me about what I did (I live in a small town where everyone knows me and a town that loves to gossip) and then press a lawsuit and all this other good stuff. No, the agreement was to pay me the 1 buck BEFORE the end of their shift if they wanted in. I think the person knew they didn't have a dollar from the beginning and thought I would front them. The agreement was also that they would sign the back of the ticket next to my name when they paid the dollar thus making the contract complete.

You clearly had a contract with your coworker to split the cost and split any winnings, and you clearly agreed to buy the ticket on their behalf and be paid later. You clearly bought the ticket with the intent that you would be co-owners with equal shares. At that point the coworker owns half of the ticket. i have lurked for a while and this is my first post. hi to all.

i run a pool of 12 at work and will let them pay me later, mostly because i don't see them often. we have an oral agreement that when i see them or call them they pay what I say they owe. some will deposit in my credit union account because they work at a satellite plant that is 45 miles away. another part of the agreement is if they miss a payment they are out of the pool FOREVER. i only asked/let guys in that i trust and have...
