His mother was looking for his best interests if he was stupid enough to promise some one a million dollars for picking up a $2 lottery ticket. Once the word was out people would have been lining up at his door expecting a million dollars for some favor they too had done for him in the past.

Whenever I go somewhere to buy tickets for others, I ALWAYS make sure I play their numbers, too. I remember when this guy worked in Nashville and one of his co workers was going to buy lottery tickets in Kentucky (TN did not have a lottery then). Well she bought him a 2 dollar quick pick and he won 100+ million dollars. I know she was sick. If you noticed, caliGal only ever made one post and that was to start this thread so I doubt if it was ever true but rather just someone way of stimulating some discussion.

When someone asked the question What was the intent of the person giving away the tickets? it brought up a similar question about LP members who post predictions. According to the story the tickets were handed out on Monday. The drawing was on the following Wednesday. When the ticket was given as a gift it wasn't a winning ticket and was therefore worth only the cost of the ticket.

I'm guessing the original post about gift tax was only supposed to be a joke. If so, it was a pretty good one.

Whether or not this poster is telling the truth is no moment to me. But she raises interesting legal issues that lawyers love to argue about in a court of law.

Firstly, it is not disputed who purchased the ticket. It is also not disputed who owned the money that paid for the ticket.

What will be asked is:

How did the ticket get in the hands of another person and not the purchaser?

The value of the Ticket at the time it was given as a Gift was $15,000,000. (Multiple Winners made it worth $7,500,000 and a $7,500,000 Gift) He is then liable to Pay Gift Tax on the $7,500,000 Gift!

If on the other hand he had given each person in the Bar $1 and they went and Purchased Lottery Tickets and one of those Tickets Won the $7,500,000 Jackpot he would not be liable for the Gift Tax on $7,500,000.

Did you guys miss what I showed here???? There were 2 winners here so it's impossible that the guy or whoever won the whole 7.5 million!! He supposedly was going to walk away with 3.9 and that sounds reasonable if he he opted for cash value but he wouldn't be walking away with that if he only won 1/2 of that,right? Or am I missing something here????

They shouldn't pursue this AT ALL. They will end up regretting it in the end. If the winner finds out this person is taking legal action against him, he will RECEDE the $100,000 offer PLUS they will have thousands of dollars in legal fees. They have nothing to complain about. Her dad GAVE a lottery ticket to someone else and it won. If I was them, I would just take the $100,000 if the guy hasn't receded the offer so far. They will lose the lawsuit, and could end up in the poor house when the law... [ More ]

It all boils down to the INTENTION of your dad when he passed them out at the bar.

Did your dad intend to make a gift when he passed out those tickets?

Or did he intend to share the proceeds, in case the tickets won?

Or did your dad intend the passing out of the tickets to be a joke at the moment, and he actually did not have the intention to relinquish ownership of the tickets?

I wish more people would understand there is no unspoken understanding . Either an agreement has clearly been made or it hasn't. I don't buy lottery tickets for others, and I don't ask others to buy them for me. There's too much I deserve a piece thinking going on. A few years ago a similar case happened in Alabama which doesn't have a lottery. It was featured on the TV news show 60 minutes .

This guy took regular trips to Florida to buy lottery tickets and regularly handed some of them out at the local coffee shop to the waitresses as tips when he had breakfast. One was a jackpot winner and the waitress who had it quit her job, cashed the ticket and didn't share the winnings with her co-workers or the guy that bought it.

I believe Uff Da is correct, but you did give me a heck of a laugh, Raven! However, when you give someone a house, that is considered part of one's estate and there is gift tax. He'd probably win, but someone at the IRS might want to challenge this. I guess as long as he never knew the worth of the ticket and never claimed it as his own, it's only a one dollar gift.

The gift (the ticket) was worth only one dollar at the time the gift was given, so no taxes are due. That is different than if he received the money, then gave millions of dollars away.

A gift is a gift is a gift. Do you suppose the father will have learned that he does not make good decisions while under the influence

The guy doesn't owe your dad anything. Maybe your dad should't have bought lottery tickets and pass them around the bar. People get mad at me when I tell them I won't buy them a lottery ticket while I'm out somewhere, and they can't figure out why since it's only a simple task. We're talking about MILLIONS of dollars here people! I swear, people need to take buying lottery tickets more seriously.

About five times a year a total stranger comes to LP to share a story about how they or a family member are being cheated out a share of a lottery jackpot. I agree with above posters. First, this is not a real story. Second, if it were, he's SOL because he gave the tickets away. The winner owes him not one red cent, and he should be extremely grateful he's been offered the 100k. When the tkt is presented at Lottery Ofc for validation--the winner of any large Jackpot has to answer questions about its purchase--usually regarding date, time and place of purchase as well as whether the tkt was a Quick Pick or not. Many larger stores also have security cameras rolling. you say he gave tickets away then what makes you think the persons he gave them to owe him anything. If you give something away doesn't that me you gifted it a away.

Please help! My dad went out monday night and decided to by lottery tickets and passed them out at the bar. Well needless to say, someone won the jackpot of $7.5million. Now the guy who won (whom my dad knows) says he will not give my father any of the winnings, then said he would give him $1 hundred thousand of the 3.9million he will be walking away with.
