For each of the past 10 years I have had between 5,000-10,000 in taxable winnings from casinos and between 5,000 -10,000 in taxable lottery winnings. You can claim a loss on your tax forms up to 100% of your gambling winnings and I do that each year. So they may take the tax at cash in but you should get a refund on yout tax return if you do it this way of course it depends on your income and many others things if you get a refund. (depending on how you mitigate based upon your tax bracket).<br /><br />For my state there is no state tax, but you must pay 25% federal tax. For $5,000 this would amount to $1250.<br /><br />So if he&#x27;s giving you $250, you would still be on the hook for another $1,000 to the IRS.
