A Victory for All of Us: by Chris Hedges

U.S. District Judge Katherine Forrest, in a 68-page opinion, ruled Wednesday [May 16, 2012] that Section 1021 of the NDAA was unconstitutional. It was a stunning and monumental victory. With her ruling she returned us to a country where—as it was before Obama signed this act into law Dec. 31—the government cannot strip a U.S. citizen of due process or use the military to arrest him or her and then hold him or her in military prison indefinitely. She categorically rejected the government’s claims that the plaintiffs did not have the standing to bring the case to trial because none of us had been indefinitely detained, that lack of imminent enforcement against us meant there was no need for an injunction and that the NDAA simply codified what had previously been set down in the 2001 Authorization to Use Military Force Act. The ruling was a huge victory for the protection of free speech. Judge Forrest struck down language in the law that she said gave the government the ability to incarcerate people based on what they said or wrote. Maybe the ruling won’t last. Maybe it will be overturned. But we and other Americans are freer today than we were a week ago. And there is something in this.

The government lawyers, despite being asked five times by the judge to guarantee that we plaintiffs would not be charged under the law for our activities, refused to give any assurances. They did not provide assurances because under the law there were none. We could, even they tacitly admitted, be subject to these coercive measures. We too could be swept away into a black hole. And this, I think, decided the case.

This is where Eduardo Saverin comes in. The Facebook co-founder, who finds himself a few billion dollars richer this week, recently renounced his US citizenship. And, to the intelligentsia, it’s not ‘fair’.

‘Saverin needs to pay his fair share! He owes America more,’ they whine, completely ignorant that the 30-year old is already forking over a $500+ million exit tax (which may end up in the billions).

Apparently it’s not good enough that the company Saverin co-founded has created tens of thousands of jobs, spawned entire industries, and produced oodles of new millionaires. Oh yeah, it’s also made things [] easy for the CIA, NSA, and FBI. You’d think Uncle Sam would pin a medal on his chest.

But no. Saverin left behind a lot of value and decided to move on to greener pastures in Singapore. Now the do-gooders in Congress are cooking up new legislation (the EX-PATRIOT Act) designed to permanently bar ‘renunciants’ like Saverin from re-entering the United States.

It’s interesting that, rather than change their ways of doing business and introducing legislation that provides incentives for productive people to come here and stay here, they maintain policies that chase people away, and introduce new ones to lock the door after they’re gone.

Societies that are actually free, fair, etc. don't need to constantly remind you that they are.

Man sues city over seizure of house with underground shelter.

Joe Del Rio was awakened to find city officials at the door of his lifelong home in East Austin, demanding entry. Before it was over, the Police Department's SWAT team and the Fire Department had been deployed, and Del Rio said he was detained and questioned for about 10 hours because of what officials called a multilevel bunker-like space under the house with suspicious and unusual materials.

After the city billed Del Rio in April for about $90,000 in repairs it said were critical to make the home on Canterbury Street safe, Del Rio sued the City of Austin last week for what his lawyers say was a heavy-handed and unconstitutional seizure of his property without compensation.

"The ordeal they put me through was unnecessary," Del Rio, now 72, said the afternoon before the second anniversary of his forced eviction. "I've gotten the runaround. I think they want the property. Condemning it is a cheap way to get it."
