Lots of luck trying to make money in the lottery. You can only claim deductions equal to your winnings. For that reason I save all of my Pick 3, Pick 4, and scratch offs. Hummmmm ... something doesn't add up. I have bought scratch offs from over the counter, from numerous states, and they did not scan the ticket. They just grab the quantity I bought, collected the money, and I walked away. No record of what I bought or when I bought it. This applied in new Jersey, Texas, Oklahoma, New York, and Pennsylvania. According to my reading on the web I believe a proportional lottery pool would be acceptable to the IRS, but the burden of proof that such an agreement existed prior to the drawing is going to be on the winners. I've read some reports of cases on the web, and my conclusion is that if a person doesn't want a lot of money going out in legal fees fighting the IRS (and still likely losing), one had better make the evidence as clearcut as possible. As Uff Da notes, the agreement can be canceled at any time by either party. Of course they may need to prove that the agreement was canceled and when it was canceled, so if things fell apart a few days after winning a jackpot it could be messy.
