The invasion needs to be stopped at the US border if not sooner. Jarasan had a brilliant idea of loading buses full, then filling military planes full and flying them back to their native countries. Under declaration of national emergency that may be what comes about. Below is what my layman's understanding of the law will be in place in order to return them to nation of origin without benefit of court hearing. If we have any attorneys reading please correct any errors.
Habeas corpus is a recourse in law whereby a person can report an unlawful detention or imprisonment before a court, usually through a prison official.

The Suspension Clause of the United States Constitution specifically included the English common law procedure in Article One, Section 9, clause 2, which demands that "The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it.".
