Illinois will be the first state in the United States to abolish cash bail

Published:

"The Pretrial Fairness Act abolishes cash bail and provides for a presumption in favor of release for misdemeanors, traffic offenses and other petty offenses, provided a defendant is not deemed a risk to the community by the arresting officer."

Never was arrested so I don't know the pretrial process or how the bail amount is determined. I know of a woman that lost her house when you used it as collateral to bail out her son. He was arrested on drug related changes, missed several court dates, and the bail bondsman had no other choice.

One of the primary goals of the law is to make sure that we're having in-depth, detailed hearings when we're taking away someone's freedom"

Interesting law, because pretrial incarceration there is a presumption of guilt especially for misdemeanors. Many people spent time in jail and later were found not guilty.

Maybe someone here had experience and can explain the process from arrest to arraignment, pretrial bail hearing, and how long someone that couldn't post bail was in jail.

Read lots of Online misinformation about the Illinois Pretrial Fairness Act including that violent criminals with priors would be let go. People with too much time on their hands are still saying without evidence Trump won the election too.

"The goal of the Pretrial Fairness Act was clear: to move away from the existing wealth-based system of pretrial detention in favor of one based on an offender’s level of risk of reoffending or fleeing prosecution. The new law abolishes cash bail and provides for a presumption in favor of release for misdemeanors, traffic offenses and other petty offenses, provided a defendant is not deemed a risk to the community by the arresting officer."

* Not surprising, the person with the insights into our justice system felt the need to be the 1st to address the issue. The fool did the same when Tipton's name came into the picture awhile back. Seems to me that he hit the books in the library while in the pen.

Because of the seven-year stretch, he probably doesn't understand not very many people here are uneducated and not very intelligent. Based on entry titles and the number of comments, Trump's uneducated MAGA Kool-Aid are the only ones agreeing with him.

His fast exit reminded me of playing Monopoly; "Go Directly to Jail, do not pass GO, do not collect $200"

There are one or two people reading my entries that don't know how to click on a link making it very difficult for them to comprehend the difference between my opinions and the opinions of the whomever wrote the article in the link.

Don't expect childish name callers to intelligently read and understand anything more sophisticated than a "Dick and Jane Level 1 Reader". Bet the highlighted quotes confused the crap out of someone with a "missing seven years".
