I know of no pastor that went to jail for a noisy church. Black Churches in the South are very lively. In most you will have at least drums, organ, piano, tenor and bass guitars. I have been to churches that are in neighborhoods where the sound spills out into the neighborhood, the people never complained, they just sat on their porch and listened to the good singing and preaching coming out the church. In fact, it had a calming affect on the community.
