If it gets to court its not a joke. Think about that. Nobody is going to file a lawsuit and go to court claiming it was all a joke. Arrested for buy too many Lottery tickets?
Qualified Immunity for police is not a defense in all states. More importantly, it does not apply if a constitutional right was violated. If the arrested individual was a minority or other protected category and could prove in court that they were targeted, qualified immunity would not be a defense. We all see police court trials all the time for police misconduct.

You say the judge might be uninformed, but the reality is you know you don't have any proof that would have a chance in court, and frankly, you wouldn't be able to find any attorney stupid enough to even consider taking your so called case. If you both tell the court there was agreement, laughingly or not, the court will likely uphold that agreement. Even if you are laughing, and they laugh too, there was an oral understanding, an offer tendered without conditions and acknowledged. In most states that would be an oral contract. G
