If someone throws away their losing scatch off ticket, fantasy five 2nd chance entry, or SuperLotto 2nd chance entry--Then someone else picks it out of the trash and enters it online themselves-- Is this ok to do? Or can only the person who purchased the ticket be qualified to enter it online?

Charlie- if it is in the trashcan its yours, that is why it was thrown away- unless the person signed the back of their * Fantasy 5/SLP tickets- in which case l honestly have no idea how the lottery committee would rule on that one.
Have you been going through the trash....again? Oh Charles.!!!

I personally don't see anything basically/ethically wrong with it, but if you wanted to get technical, I'd think it would depend upon the city ordinances and if there are laws against rummaging through the trash. There might be a law against going through the trash of a business or a household. For instance, my town prohibits people from "dumpster diving". (but it's still done f/ aluminum cans even though it's illegal) The law is not only there for health reasons, but for the privacy of the people who use the dumpster; even though you might shred credit card receipts, etc., there could be plenty of things you wouldn't want others to know or find. Once the items are deposited in the trash, it becomes the property of the city. The law applies out at the dump, too; no matter if you find something useful, you can't claim it and take it off the property. (a city employee was fired f/ that a yr. or two ago)
EDIT TO ADD: My youngest niece used to pick up scratch tickets off the ground and out of the trash; she found several winners, usually just for a buck or two but she did find a $20 winner once.

That's what I thought, just curious to hear some feedback--I've already won 11K on Fantasy Five 2nd chance.. 10K in August and 1K Jan 2014. I'm not sure if it's from my purchased entries or from a stack of losing tickets in the trash, (More than likely the latter, I just avoid the cans w/spilled drinks!) I suppose they know people have submitted an inordinate amount of tickets in the past, so to make it more equitable they have limited the amount of entries to 1000 per month. Has anyone else out there been successful w/2nd chance entries?
Edit: Good point.. I found two winning tickets yesterday that were thrown away, (2 free tickets).. I also ask the store owner if I can take the tickets out before I start my rummaging :)

We aren’t lawyers but this is our best understanding as plain-old US citizens.
Dumpster diving is legal in the United States except where prohibited by local regulation. According to a 1988 Supreme Court Ruling (California vs. Greenwood), when a person throws something out, that item is now the public domain. Here is some language from that ruling: “It is common knowledge that plastic garbage bags left on or at the side of a public street are readily accessible to animals, children, scavengers, snoops, and other members of the public.”
However, if a dumpster is against a building or inside a fenced enclosure marked “No Trespassing,” you could be questioned, ticketed or even arrested by the police. Other law-enforcement tactics to discourage dumpster diving include:
- to ticket or arrest in our experience, this is yet another good reason to be courteous with any store employee (or resident with a dumpster) who questions the dumpster diving in progress, and to use common sense about how long an individual or group stays at any one trash location. If anyone asks you to leave, consider doing so, even if the law is on your side– there are plenty of other wasted resources to be found.

Yeah, like I said, depends upon local ordinances. There are stickers on the front sides of our dumpsters citing the specific law. I was doing some some long- needed sorting of stuff in my house several months ago and late one night (past midnight) was making multiple trips out to the dumpster in the alley behind my house; the people across & behind from me have dogs and every time I went out they started barking and the mutts would barely get quiet until the next time I went out. I had done it a dozen times and the last time there was a cop car parked down the alley w/ its lights off. All of a sudden, the lights came on and the cop got out and told me to stay where I was w/ my hands in plain sight. I was more annoyed than scared, but I did what he commanded. He wanted to see my ID, but I didn't have my wallet on me. (who carries their ID when they're at home?) I told him who I was, pointed to my house, gave him the number and even recited off my TX DL# to him and he "ran" the information. Nothing on me, but when he got off the radio he told me I should call it a night. Well, I was basically through but wanted to challenge him that it wasn't a lawful order, but decided I didn't want the hassle or be taken down to the station and charged with "excessive spring cleaning" or some such. The dogs were the one breaking the peace, not me!
Anyway, long story short, he told me at first he thought I might be some old man he knows who gets cans out of the dumpsters; I reminded him that it was against the law and he said that was one they overlooked...at least they did for him.

What they don't know won't hurt you, but if you win something and let it be known that you found your ticket in the trash then everyone who ever threw away a ticket will think what you won belongs to them.
* you don't need to buy every combination, just the winning ones *

I'm curious if you don't mind sharing. Of your two Fantasy 5 winners, approximately how many were entered in those draws you won?
I started only recently, in November, but I have a big goose egg thus far. It is somewhat encouraging that people that live in my city and surrounding neighborhoods have won.

Same here MrC- l have bought lots of tickets with " 2nd chances" and have won a goose egg as well. The winners must be living across the street.
