You can not owe nothing they take hospital state fed loans anything that comes up they take and pay it out of your winnings

    Need help.. My friend just won the pick 4 for 2,500.. He is asking me how much tax they take out? Will they take his winning if he owe the state? He is worried about a loan and hospital bills and etc.. SO CAN SOMEONE HELP ME WITH FACTS//MYTH OF THIS.. SO I CAN TELL HIM.. Im just a pick 3 specialist.. Well at least I try to be.. lol .     The lottery office, as I understand it, only has authority to take what you owe governmentally. So, any and all debts to creditors you owe to private businesses can't be taken because the lottery doesn't have jurisdiction under the law to do that.

    So, if you owe a private hospital that is not government, then I don't think they be able to take that amount from you because they shouldn't be aware of that info, have access to that info or even if they are aware that they don't have authority to seize that money amount because it's a private debt matter and not a governmental one. It has something to do with the way in which the by laws of the state lottery were created.

    An example would be - does your friend have an outstanding debt or bill to a county funded hospital or private ? cause if it's county funded, then the lottery as a state department has authority to collect the money amount to satisfy the debt because the hospital is a government institution owned and funded by the state and by state and federal money.

    I remember my aunt years ago hit on a $ 1,000 itch card. She got me to go in and make the claim because she knew that she owed both the federal and state department of revenue.

    If, for example, you owe a private debt such as to a department store, then a government office like the lottery doesn't have the authority to deduct any money from your winnings for that because its not : 1) under the authority or jurisdiction of the state lottery and 2) they shouldn't be able to have access to that info or be aware of it anyway.

    If anyone else has anything to add to this, let us know, but I believe I am correct here.

      for today, still like something with the 87 pair as I don't think we've had that pair a lot in the last 2 months. The 8 is still a fairly cold digit. I think it's time now more for the 13 sum instead of the 14 sum.

        i am telling they do a credit report if you owe anything they taking it and paying it off for you hospital childsupport anything one of my friend hit $10,000.00 on a scratch they came back with $137.00 dollars

          Yes they will take out any hospital bills and or child support owed anything that is owed will be paid first out of the winnings . I won 5k on a scratch card taxes when all said and done was 3300 . Good luck whatever he decides to do and congrats on winning. I like the pick 3 better for that reason too many taxes taken out on over 500----oops i meant to say that 3300 was when taxes were taken out and state and fed were paid.

            yes, but child support, as we all know, is controlled and regulated by county and state governments - it's a government matter - enforceable by, for example, the local county sheriff's department, the state or county department of social services, etc. So, yes, if you owe child support, that is something they can legally withhold from your winnings.

            On the other hand, if you owe Visa credit card company or any other loan or debt to a private company, the lottery cannot seize that debt amount of money. I don't think the state lottery can do a credit report to seize and collect private debts, regardless if you have bad marks on your credit from not making payments to various companies.

            Now, the lottery probably would have authority to deduct money from your winnings if that private creditor has filed a civil summons to collect money lent or owed because you have failed to make your payments. An example of this would be if you had taken out a loan from a lending business in these strip malls that we have all around our state. If you don't make your payments for example, they can file a civil summons to collect the money through the county court which then means you have a judgement against you, and that makes it a governmental matter and then the lottery can therefore seize the money owed/lent ( including interest, court filing fees by the lender, etc. )

            If I'm wrong on what I have said so far and someone does in fact know more or better, someone please jump in here and correct me.

            Long story short, if your friend has these issues, just tell him/her to get a friend to go claim it for them and spot them a tip for their help like a true friend would.

              I think you summed it up very well but I would urge doing a credit report on any "friend" that you get to go as well. I've heard horror stories over the years as well ....someone didn't know a "bill" was on their credit .They can only take what is showing up on your credit report ((hospital, government loans leins judgements and etc.)) not every debit that you owe. I once heard of a man doing this and his "friend" owed as well guess who got credit for that. Once the card , or paper is handed over to the lottery official they don't come back to the window and say wow you owe us all of this amount they take what they are supposed to and cut you a check for the difference. Good luck in his choice.

                          You have that wrong about taxes taken out over $500 as it's over $600...I've won $600 several times since the lottery started with p4 & no taxes were taken out...it's $601 & over.

                          I only know about what was taken out from personal experience with $600 & $1000 because I won both of those.

                          I don't know how they will get anything if you won $601 but you probably won't win that amount from anything anyway but that was how it was worded to me when I took my tickets in to cash them in here at the claims office.

                          Also if you win $600 with more than one ticket you still don't owe any taxes because each winning ticket is a seperate payout.

                            I looked at your list just now and am adding one more to my list...we'll see if it hits or not at 3pm...haven't bought any yet so better go ahead & get something down on the slips!
