I'll ask my tax man about that. I know folks that have won @ the casino, got taxed the hell out of and they refused to be double taxed by reporting their winnings. I'll never declare my small winning on the lottery. As for my casino, I do win/loss statements. Burden of proof on the IRS if I won small wins on the lottery which are ALL cash payouts.

The casino should simply compensate her. While I'm not certain of the specific laws, it's widely known that casinos have a reputation for their actions, even under surveillance. Should this matter proceed to court, it would likely reflect poorly on the casino. Then if she does make out ok with a lawyer, the lawyer is laughing to the bank anyway. This is why I have zero interest in casinos. If the prior case fact pattern is that similar or identical, sounds like a solid case. The casino hired that company, IGT. One cannot avoid liability by shifting the blame to a contract hire. This would not be a good case for the casino to take to trial.

All lottery winnings are taxable. If you win $300 a week every week, it is still taxable and reportable on your tax return. Lottery wins of $600 or more are reported to the IRS by the lottery. Just because an entity like a casino only withholds taxes over a certain amount of $, this has no bearing on the fact that all winnings are subject to taxation and reportable on your tax return.
