NYS Lottery commits fraud in sales of Scratch off game

After an investigation into the NYS Lottery division's practices of how the conduct their sales of Scratch offs I have no choice but to conclude that NYS Lottery conducted an all out attempt to prevent the final top prize of Game 596 1 million dollars a year for life scratch off from being claimed. I lay out the conclusions and facts as I have found them.

 

I have called and/or visited over 2000 retailers throughout NYS with dates and times and retailers names and was told that as far back as July of 2015 the NYS lottery and Gtech representatives were visiting their retail establishments asking for their open and closed books of game 596 be handed in to them for credit, to be destroyed and that the game  was over. When in fact it was not until August 11, 2015 when the game was actually called for retirement with 1 winner left. That meant that NYS Lottery and Gtech had NO MORE books to distribute and with 1 final remaining top prize left, the retailers could sell what they had left, open and closed books and any winning tickets could be claimed until August 11, 2016, which meant that in reality they could have sold their tickets until at least 1 month before Aug 11, 2016. 

 

Starting around October of 2015 NYS lottery and Gtech aggressively started to send representatives around NYS to collect all books open and closed for destruction with the language stated to retailers that they HAD to return all books because they could no longer sell those tickets. This was a blatant lie right from the get go. 

 

As of about 2 weeks ago there is not 1 retailer left with tickets to sell that I could find only supporting my theory that they tried to prevent the ticket from being claimed Not only that a representative from the legal department admitted that NYS Lottery does not have a standard policy of how to remove tickets when the game is ending and that the usual procedure is to START recalling tickets about 6 months before the final date for claiming. NOT 1 year or 8 months but 6 months only adding speculation that there is some kind of fraud being conducted here. Until August of 2016 we will not have the final figures of tickets that were destroyed for this year but I am sure that it will be a very high number maybe even besting the entire run of destroyed tickets with this one year alone. 

 

I have filed letters of intent to sue and for a request of an investigation to all the members of the NYS Senate and Assembly gaming committee members who over see this operation as well as the Southern district federal District Attorney and every district attorney for every county that sells NYS lottery. 

 

At this point whether this goes anywhere at the very least it has called into question the illegal practises of the nYS Lottery and GTech and I have lost faith in how NYS conducts their policies and systems. After this I have vowed to never again support the NYS lottery system and will buy my tickets for 1 years worth of games through another states mailing system and will never again support the NYS Lottery. 

This is a violation of our trust and a blatant manipulation to prevent the final winning ticket fo ever being sold. This ticket is in such high demand that the state of NY could have made a lot more money by just letting it sell out because every retailer has said they get at least 3 people looking for the tickets a day. If any comes across a retailer that has any left would you please in box me I would like to speak to that retailer. This was for everyone;s information to know how our lottery is conducting their business and how they manipulated this game. I thought everyone should know what is going on.

    Have you retained an attorney that specializes in dealing with this type of fraud ???  Have you gone to the snail media [TV] yet,and encourage them to conduct an investigation ??? Have you gone to social media yet, to shame the NY Lottery Commission ??? What advice has your attorney given you regarding the strength of this particular lawsuit ???  Do you have the money $$$ yourself to pursue this case ???  Do you really want to fight this uphill battle ???  Perhaps you should try to crowd fund this lawsuit !!!  Can you file a class action lawsuit on behalf of all of the citizens of New York who purchase lottery tickets ???

      My nick name is Donafello and have a you tube channel with the same name. I have been scratching almost $200 a day in tickets for the last 100 days on my channel live on video. Now I;m not even going to get into the amount of losers I have pulled, but I have to voice my concern about these $30 tickets. When I first started the channel I had a few stores that had the tickets in stock and I was buying them with no problem. Then a week it and all of a sudden the stores I went into that had tickets were telling me that lottery came in and took the tickets away. within a week all stores by my house that had tickets were all out of them. Then about a month or so ago i found a store by my job that said the official came in and took their books back. But he told me they forgot about the machine he had in the back of the store. That machine had about 15 tickets left. i managed to buy a few over the course of a few days and then I went back to buy the rest and they were gone. I have now been on a mission to find these tickets and they are no where to be found. It's not fair to us that this happened and I want to be part of this law suit. i have money to help back this and have a subscriber base of over 4,000 which I'm sure a decent percentage are also pissed about this. Never mind the problem of not knowing what percentage the payout is per game. I know a lot of states post a 75% or better and I can assure you that NY lottery has to be under 50%. I have 100 days worth of a massive amount of tickets to prove this. There has to be an investigation into who over is in charge of this because I can guarantee once someone starts sniffing around they are going to open a can of worms. But I'm also not stupid and when you are dealing with something that generates the amount of money the NY lottery does, we will never get a answer of any wrong doings. They might fix things behind the scenes but to risk losing a lot of customers with a scandal, they wont let that happen. I'm here if anyone wants to really pursue this.         You know I hate to say "I told you so" but I told everyone about this about this particular game and NYS Lottery's shenanigans with it over a year ago. But people here had a lot of faith in NYS Lottery even making claims that they would never resort to ethically questionable behavior.

        It is one of the reasons I believe they got rid of their Winners Atlas and don't accurately reflect their Remaining top prizes page.

        They have gotten worse over the years but if there is one thing I know they hate is bad press. They recalled whole games before because of bad press they received.

        Since they  care about profits and image and people aren't going to stop playing lottery games; a public shaming in in order as suggested in an earlier comment.

          Enigmas I am sorry because I was one of the people who really did have faith in the NYS Lottery and I also responded and told you that. I really did believe it until the retailers actually told me to my face that the tickets were removed all these months earlier. Now I am a believer. I am still looking for a lawyer but I do apologize because you were right and I was wrong and I admit it. Now I am fighting them.

            To answer ALL your questions in order:

            1-I cannot find an attorney that specializes in NYS Lottery law. 

            2-I sent my letters to as many media outlets I could. 

            3-I am not adverse in social media so for me that is archaic lol 

            4-I got no advice from a lawyer because  cannot find one although I reached out to many who were said to be specialist with lottery law. 

            5-I have some money and if I have to do it I would because it is about principle for me. And if the courts find their is some type of criminal activity than it could be a class action suit.

            6-Yes i want to fight this uphill battle because so many people want to believe that they are honest and have as much a chance as anyone else to win when in fact the lottery is manipulating the sales mechanisms. 

            7-I am going to look into crowd funding but without social media advertising how would anyone know what I am doing

            8-I would file a class action suit on behalf of all NYS Lottery players. For me this is not about money it is about changing their ways and STOP them from destroying hundreds of thousands of good tickets in the name of their criminal system 

             

            To add to this I want you to think about this. The NYS Lottery division destroys as of right, hundreds of thousands of good tickets a year for many reasons  which tips the scales of winning in their favor for good winning tickets that they destroy so we cannot win them. This is outright fraud legalized by their so called rules.

              I have sent out 30 letters dated for January 28, 2016 and 65 letters dated December 10, 2015 to every county DA, to every Senator and assemblyman sitting on the gaming commission that over sees NYS lottery division, ALL the commissioners of the NYS Lottery, The Sountern District Da. Preet Bharara, and the local newspapers. To date only 2 senators have contacted me back in December 2015 but nothing more. 

               

              The NYS Lottery's position is that they have no known set of rules to go by, when a game is called for an end date. The usual standard to take back tickets from retailers is within the last 6-8 months. They admit that it is a little questionable as to why they started 1 year before but had no answers to the why only to say they had the right. The retailers are a bit angry to find out they could have continued to sell and make their 6% but were lied to in order to return their open and closed books. 

               

              This all makes me wonder now the legitimacy of the Lottery agency. I now decided to buy my powerball and megaball tickets in Florida for 6 months ahead for powerball and 4 months for megaball. I am going to look into subscriptions but not inside NY anymore. I am totally disappointed in the antics played by NYS lottery and how they manipulated the final winning ticket from being claimed.  This game made NYS lottery the most money out of all the scratch off games and by manipulating the final top prize saved themselves at least 20 million, that is how much that ticket was worth. I believe that IF they do come out with this game again it will have a clear end pay out date and not the for life that this game gave for the winner. an 18 year old winning this game now would have been paid 1 million a year for his entire life. I believe that will come to na end and their will be a maximum end to be paid and not open ended like it was. It is sad to find out how this was manipulated and how no one really cares. As long as people can gamble is all that really matters not that it is slighted against them. I am done with NYS Lottery.

                Rather than spending all of your time and financial resources pursuing this matter, you should take this case to some very public news forum, either on local or national TV or social media [lay out your evidence], and let the media conduct their own investigation of the NY Lottery Commission.  Go to "60 minutes" or one of those national whistle blowing media outlets.  The media should be interested in this lottery story, b/c of all of the national hooplah and frenzy stirred up behind the recent Billion Dollar Powerball Lottery, b/c the public is interested in how the game of lottery is managed [even Scratch Offs, b/c a lot of people waste money on Scratch Offs]

                The game of lottery represents a "Dream of Hope of sudden Financial Security [even small scale]" that people cling to and pursue, just like the "American Dream", and people want to believe in the "integrity" and possibility of the Dream. 

                The alleged Fraudulent practices of the NY Lottery Commission seem to violate the "Dream", and such a violation of  public trust in the "system" should be investigated and dealt with by an Authority Figure who can raise public awareness and prosecute the Agency, if necessary.  Contact the NY Attorney General, Eric Schneiderman, or someone on TV programs similar to "60 Minutes".

                If YOU are going to be the WHISTLE BLOWER yourself, YOU need to GO NATIONAL !!!

                  I am going to prepare this for news shows. If you have a list of email addresses of those shows you think would be interested I will add them to the list. This is very important because it seems that this is a practice that is being done in many states. Where they destroy tickets at will by guidelines that are very ambiguous. Thank you

                    rgse90, thank you for bringing this to our attention and exposing NYS lottery and what they are doing. They shouldn't be allowed to get away with this. I hope the media picks up on this and NYS lottery gets hurt somehow. Keep doing what you are doing and fighting against evil.

                      Thank you for those kind words but I think we are definitely in the minority here. No one really cares as long as they can play their games. Although I now play my Mega and Powerball in Florida. I can play powerball for 6 months and mega for 3 months.  I refuse to give my money to the NYS lottery anymore. The sad part is that no one really cares not the people not the politicians. It makes money for the state and the hard core gamblers have to play.

                          Spoke to the acting head lottery security, and we were on the phone for more than 20 minutes. They really believe that the final ticket was either sold or destroyed and that there is no realistic way for it to appear. I argued. She said that there was a law suit in New Jersey Blah blah blah and that, that was way they decided to take the game off the shelves. But no matter what it is all very suspicious and I do not like the reasoning. So I did what I said I would do. I went to Florida and spent 700 dollars to buy tickets until August for power ball. I even told her that I refuse to support the NYS Lottery anymore. It is disappointing and that it was horrible that they did this.

                            If anyone is interested I have 39 $30 1,000,000 a year for life. They are all from the same book and from 1-39. I'm considering scratching them but am willing to let them go for a markup.  If interested let me know. My YouTube channel has all my info
