New to the forum, and had an interesting question I could not sufficiently and legally find an answer to, so >>>

in the middle of a separation leading to a divorce. Eventually. If I were to win a jackpot prize in the meantime before finalizing the divorce, and I live in a 50/50 state, how could I cash in the winnings all to myself? I'll spare you the details of why that *looks* like a moral failure on my part to not split it with the ex, but suffice it to say she's done some off the moral compass activities, and doesn't deserve the half she would have, had she kept her ethics straight till the finish line.

Since the ticket is a bearer instrument, could I then "strike a deal" with another party, keeping my name off of the winnings, and "cash in" that way, or no?

Any thoughts appreciated 👍

If it's a fifty/fifty state, it would be illegal to fail to reveal all your assets to the court.

Making a deal with a third party would be a conspiracy to deprive (defraud) the other party of their legal share.

Ask your lawyer what you can do to protect your interest before doing anything that may mean the other party gets the lion's share due to your attempts to deprive them of their fair 50/50 share.

I'm probably here unless I'm not.
Dreaming would be a perfectly useless function if it's only purpose was to entertain.

When I employed the word "dilemma", it's not like I'm caught at an intersection where I'm going to do anything illegal or unethical.

Despite my soon to be ...ex wife....not being deserving of the half, my ethics matter to me more than her ending up with half.

So the beginning query looked like it was framed so I could skirt the law. Quite the contrary.

I was looking for a *legal way* to make it happen, but it's looking like my end - around proposition would have been deemed illegal and punitive.....to me.

In the end, I'm good with however that tree shakes out.

Ethics and personal integrity > any amount of money

Stop playing until it is final. If the paperwork is still being written, throw in the clause about neither party being entitled to future earnings of the other. Not personally tested, but seems like a simple solution to the dilemma...

Taking to a lawyer is the best advice because divorce statues are not one size fits all and vary greatly from state to state. In some states the 50/50 rule applies until the divorce is final.

Not sure if I'd quit playing a large jackpot game because splitting $`100 million is still $50 million better than winning nothing by not playing.

Not playing seems to be the best solution.

Think about it. If the other party gets word this post was made and ties it back to the soon to be ex, it could be enough to convince a judge indeed one party intended to cheat.

Asking a soon to be ex to agree to a no future splits as of now would raise red flags that, unless she is earning more, would cause her to balk.

People who choose to do these things likely aren't posting their intent on the internet.

No offense intended but this is something that if you intend to get away with, you keep to yourself.

I'm probably here unless I'm not.

Man asks his wife: What would you do if I ever won the lottery?

Wife: I'd take half and leave you in a New York minute.

A few weeks later.

Man: Guess what? I hit the lottery!

Wife: Give me my half.

Man: Okay. Here's $5. Start packing.

Before you play there are 2 choices to make. Low sum or high sum and consecutive pair or no consecutive pair. Choose correctly and you go from 120 combos down to 30. Not a bad starting point.

I could tell you , but you would be an episode of Forensic Files, and we DON"T want that.

Good things happen when you do the right thing and share, if your spouse won, you would want your share!

Sully, I have always done....the right thing.

Not perfect. But my compass has always been, doing the right thing. No matter who or what is in the equation.

So I will in this case also.

It just isn't fair that she scores half off of an effort I made, where she intentionally did not cross the finish line with me.

And to add, it wasn't just irreconcilable differences. No details need to be displayed, but she tank sold me out to the lowest bidder like it was nothing.

This after many excellent years together. I am / was the textbook husband any woman would want, and her betrayal was soulless.

That said, I never came here looking to do anything illegal. I'm not THAT guy. I will never exchange any amount money for my good name.

I came here looking to see if I could craft out what's FAIR. But it looks like I'll end up splitting half, and like someone else stated....half...WITH my integrity intact, is better than if I'd never won.

Well menext........ The integrity aspect is a noble trait to consistently maintain..... For this taxpayer it means; the simple act of doing what is right at all times,especially when one believes nobody is watching......Life is never fair when it involves human emotions/thinking on various topics....Skirting the rules is a tricky scenario for anyone.....Besides,it's much easier to "stay out of trouble" than it is to "get out of trouble". Good luck with your future lottery purchases/wins.

Bad men need nothing more to compass their ends, than that good men should look on and do nothing.

Were you working on any lottery systems during your marriage? I ask this to suggest you consider that if you win your “soulless” wife might decide to sue you (after the divorce) for half claiming that she helped you with said system while you were married. You probably should stick with Quick Pics for a period of time after the divorce is finalized.

Give up her share of the money, just like Sam did in the movie, "Casino". (I used to watch his tv show in Las Vegas)
