If the O guy had said nah im not in. then  he would have only split it with 9 im guessing, shessh he gave the guy a chance to buy in after knowing it won. sounded like O was oblivious. nice to give the guy the option

The way I read this was that Oviedo "owed" the ticket buyer the $5 dollars because he "covered" him due to the fact that he (Oviedo)was working from home and not in the office the day the money was collected.

He wanted Oviedo to physically give him back the $5 dollars that was covered for him to be in the pool.

Remember it was $50 worth of ticket purchased...10 people at $5 per person with the purchaser putting in $10...to cover Oviedo and himself.

Also there was one winner, the 10th person (the guy who usually buys the ticket) who was on a business trip for Chubbs in Florida at the time of the purchase/win....if he did not leave $5 of his own money to be used, then someone had to cover for him as well......... and apparently they did!

    According to the article the O guy did tell Space before the drawing to count him in. So Space did the right thing going to O after the win to give him the chance to pay up.

    If the others opted out before the drawing, tough luck. REAL tough luck. LOL.

    Yes, I totally agree!!!!!!

    And those that opted out could have just as easily said "Yes" instead of "No"........

    You ask the people if they want to be in and leave the choice to them.

      It nice to hear about a lottery pool that players can go out on the limb and cover other players not around or a little short when the money is collected and know win or lose they will get their money back. 

      There are too many lottery pools with players who don't pay but want to be covered if they win but have the option of not being in if they lose.

       * you don't need to buy more tickets, just buy a winning ticket *

          - The Big "O" I was referring to is not the person from Chubb, but THAT ONE who wants to put higher taxes on high incomes... meaning "Take the money and run" vs. an annuity that might be a much higher tax rate in a few yrs.

          - With all the hype about HDTV, I prepared for Feb. 17th (now June) by getting a HD antenna and USB tuner. When the man waved the ticket at the camera, I clicked Freeze Frame. The winning set was on line E. They were all QP, but the other numbers look good so guess what, I'm playing them! Would be funny if someone else (me?) won off the other 4!

          - Every time I watch the News they show stacks of money being printed. I figure in a few yrs. we will all have 8 million dollars, with the only catch being a Happy Meal costing 5 million.

            Space is one helluva guy and I'm really happy to see many people splitting the loot instead of just one guy. This way, the group will help keep each other grounded.

              Space is one helluva guy and I'm really happy to see many people splitting the loot instead of just one guy. This way, the group will help keep each other grounded.

              I'm betting that at least 1/2 of the winners tell their boss to take this job and shove it and move to warmer climates.

                I'm betting that before moving they got to fight a bunch of claims from those who wanted to participate in a pool but somehow missed the opportunity.

                  Yes, it's a great story.  However, it might also open up the door for other coworkers to say they also wanted to play and would have given Space the money on Wednesday.

                   

                  Edit:  Coincidentally, KY Floyd & I commented at the same time, quoting the same post.  Anyway, please explain what you mean that it makes it harder for others to sue.  Couldn't they say "I said I wanted in, but he forgot to write down my name."   If I were in a pool, I'd want the rules to state that anyone participating in the pool has to pay before the drawing.

                  By including the player who didn't pay, but asked to be included, he demonstrated that he was willing to take care of the people whom he thought had a legitimate  claim. That  would make me think that if anybody else came forward, the guy charged with  finding out who wanted to be in it for that draw truly didn't believe that person had intended to participate. It's certainly isn't proof that somebody else wasn't unfairly or accidentally excluded, but in a case that is likely to turn on claims that are hard to prove, Space has (IMHO) established a level of honesty and integrity that is likely to make his testimony more believable and more important to the outcome.

                    It amazes me that so many pools have trouble over the small amounts that are normally involved. If they're  collecting $10 per person, the administrator would only have to kick in $20 if 2 players aren't at work or don't have the money that day. If they're normally in the pool, then you've already agreed that you're okay with the number of people who will share any prizes you win. That means you really don't have much to lose. If you front the money for somebody for the first time and you win,  you aren't losing anything by sharing with them, and by buying their share of the tickets you've also agreed to split the prize into so many shares. OTOH, if you front money for somebody and don't win, and they don't pay promptly, you've found out who they really are for a cheap price, and it was worth the few bucks.

                    As long as the people in the pool all get along the real reason to have a written agreement and collect ahead of time is  to avoid  problems with anybody who's not a regular player. If a pool is ever sued by somebody with a legitimate claim it's almost certainly going to be because they excluded a regular player because somebody was afraid they might have trouble collecting a few bucks.

                      Yes, I just love this part myself, it is what I would have done. As a matter of fact, it is what I did when I ran an office pool in New Jersey for an Insurance Company. We did'nt win the "Big" one, but we did hit for smaller prizes several times. As far as I was concerned, if you did'nt pay up, you had no claim on the winnings.

                      Great story, I am very happy for this group.

                      A side note, NO STATE INCOME TAX on Lottery winnings, so they do get a break there on taxes.

                        I totally agree, congratulations to all of you, I am so glad it was a group of people that is so cool, and I also play in Upstate New York with 36 people, so I guess you all give me hope.  And the story on the person who had someone float him 5.00 - was a riot, my group does that all the time, I certainly don't want anyone left out.  I wish you Health and Happiness.

                            I personally admired the poster who said Thank you to all who contributed to help the lottery winners. Sometime in my life I sincerely hope a person from Lottery Post wins and does the gracious thing by Thanking the contributors. We are the reason the jackpot got so high and Lady luck was simply there to open the gates of good fortune.

                            It neednt be a lottery pool to make the odds of winning. It takes but one line and one dollar.

                            THe folks do seem nieve in annoucing it before officially claiming it. My opinion is...it is not theirs' til the ink is placed and the state offically announces it as the winning ticket.

                              yeah my point i ws trying ot make is that it sounds like the sort of pool you wanto be in. not one where you say you'll be in and because you whern't there you lose out. thats old school honour. the sort you read about in books because you dont see it in real life. :|
