    First off, it would never happen with me.  Second,  I would wring the clerk's neck if it did.  Third, the states should establish some set guidelines for dealing with this potential problem and stick with them.  There should either be recourse for being stupid or not and make it permanent.  Any clerk proven to have defrauded somebody should have to do time and have to eat 7-11 microwave breakfast sandwiches for the duration of their incarceration.

      technically the ticket is the bearer instrument. meaning the person that presents the ticket to the proper payment athority will get the prize. However there my be instances where this would not apply.

        This is a tough guestion because there are too many variables how would you know it was yours unless it was the only ticket in the trash.

          MORALS OF THE STORY:

          1. Don't rely on anyone else's honesty when it comes to collecting your lottery winnings.

          2. Always check your own tickets via telephone, internet, laser barcode scanner, winning numbers printout slip, newspaper, live TV drawing, or news reports.

          3. Always check your tickets against at least two different sources before cashing or trashing them.

          4. When trashing tickets, always destroy them beyond use.

              Everything you all said is cool i mean we might do that check them thourally but the general public ususlly dosent. I was in the royal farm store yesterday and they have a scratch off vending machine next to the coffee dispencer. in the trash can where they toss out old coffee grinds and stuff there were hundreds of scratch off tickets thrown out. sometimes if is not to dirty and i humble myself and dig them out, i have found many tickets worth anywhere from a freebee to 20 bucks. I figure it's a matter of time and i might find one worth big bucks. many of those tickets wern't completly rubbed off a lot of them had bonus areas not rubbed off.

                 Excellent point four4me,  who could testify with any degree of credibility that they watched the trash so closely they knew there was only one ticket in there?

                    I agree.  If I had went to that store and played that same game and threw a ticket in that same trash can, I'de come back and say it was mine too. I think the state needs to use this incident to show the importance of double checking tickets and signing them. To be honest I don't think the 2 guys had the winning ticket. Think about it, how does 2 men, a clerk, and a lottery machine not see it is a $100,000 winner. Then on top of that, of all the people who played the game and threw tickets away, how do they know it was their winning ticket that was pulled out of the trash when they thought they won $40.00???? This story would be more feasable to me if the guys thought they won $100,000 from the git go.

                    I love doubles and remember, it's just a game!!!!!!

                              Yea those who dont check their tickets right away... it really goes to show just how badly they wanna win.
