"Let's say you have to or are dumb enough to a give a press conference and you mention that you won using a combination of family member birth dates."

It's not dumb if you have to give a press conference. It is dumb if you give a press conference and don't have to. I thought what I said and meant was pretty obvious.

As far as being selfish, I meant it in the sense of what some other people would think. That may or may not have been so obvious.

May the balls bounce in your favor!

So, with this logic, I could sue my brother because he was born a day too early and cost me a 100K because all my other siblings birthdays camel out, right?

No they can't besides you didn't use "Their" birthdate    You can't help the numbers you played just so happens to be their DOB

Stay In The Vortex, you'll be happy you did ..... Random? Seriously? You want me to believe that?

You pretty much answered yourself: Don't be selfish and you won't get sued!

You'll be O.K. if you follow these Golden Rules:

            1. Worry about things you can control and change by your actions not about what is beyond your capacity to alter or direct.

            2. Examine your life, engage it with a vengeance and search for new destinies and pleasures to reach with your mind.

            3. Treasure true friendships since they cannot be acquired in the market place but can only be nurtured in relationships full of amity and trust.

            4. Master yourself and resists outside forces that try to delimit your thought and actions, cease from deceiving yourself.

            5. Live a balanced life and avoid excesses.

            6. Act responsibly and stop blame shifting for your shortcomings and errors.

            7. Prosperity is not a cure-all by itself; money is necessary but not a sufficient condition to live a good life full of wisdom and happiness.

            8. Do not seek to harm others or repay evil with evil.

            9. Kindness will always be rewarded in the long run.

            10. You can learn something from everyone.

Well, what if they think what you give them isn't enough. The point of the poll is do they (the family) have a case.

In the example that I gave, you (the winner) specifically mentioned at the press conference that you used your families' birth dates as inspiration for what numbers to play. The question is, do they have a case for a share of the money?

This has been asked and answered multiple times.

1.Anyone can sue you for anything and you would still have to hire an attorney to file a motion dismiss.

                        2. Is there precedent for Plaintiff to prevail? Unlikely. Birthdays are not unique and are simply numbers on a calendar.

                        3. Could someone sue you for inspiration/ideas in other areas...like unique books, scripts, etc. and likely survive a motion to dismiss. YES . Although, mere ideas are not subject to copyright protection so it would have to be more like an outline vs idea.

You're not obligated to attend a press conference.  Form a LLC and have your attorney collect the winnings on its behalf.

They can sue. Anyone can sue, for any reason. They can also get laughed out of court.

In response to the Thread question- Absolutely Not. Which begs the question why?

l am no lawyer but.. Numbers are classified as public domain.

Two: It is NOT intellectual property.

Three: It falls under " fair use."

** Case in point : James Cameron had an avalanche of lawsuits filed against him for what some writers claimed was " Idea theft" for the movie Avatar. All of those claimants Lost in court even though they claimed that an idea here and there in the movie could or may have come from their original work. The courts ruled that one " cannot copyright an idea." but only the expression of the idea.  How could one claim ownership of a date or numbers for that matter?

People who say it cannot be done should not interrupt those who are doing it- George Bernard Shaw.
