Court: No right to resist illegal cop entry into home

Wow. Just ....ing wow.

INDIANAPOLIS | Overturning a common law dating back to the English Magna Carta of 1215, the Indiana Supreme Court ruled Thursday that Hoosiers have no right to resist unlawful police entry into their homes.

In a 3-2 decision, Justice Steven David writing for the court said if a police officer wants to enter a home for any reason or no reason at all, a homeowner cannot do anything to block the officer's entry.

‘Rapist Doctrine’: Don’t Resist — You’ll Just Make It Worse

"We believe ... a right to resist an unlawful police entry into a home is against public policy and is incompatible with modern Fourth Amendment jurisprudence," David said. "We also find that allowing resistance unnecessarily escalates the level of violence and therefore the risk of injuries to all parties (but more likely the homeowner) involved without preventing the arrest."

David said a person arrested following an unlawful entry by police still can be released on bail and has plenty of opportunities to protest the illegal entry through the court system. (And perhaps even "protest" for the replacement/return of items that were broken/stolen, whatever that's worthRoll Eyes)

Bomb Scare Shuts Down Dallas DART Station

 

Dallas, Texas—

Around noon,  Dallas Police and DART Police shutdown the Mockingbird DART Station and cordoned off the entire area.

Buses were brought in to get the passengers where they were going. But many were confused about what was going on

"It inconvenienced me. I’m trying to take my mother to a mother's day lunch today. And I just came from downtown and they didn't say anything. They just told us to get off and catch a shuttle back up here", said passenger Nathaniel Brown.

"I was coming north on the northbound coming out of downtown and people getting off the train and everything and police were down there saying get back on the train; no information or nothing", said passenger Dale Rickard.

DART says what led to this was a man who was spotted at a downtown train station getting on and off the trains with a large duffle bag and large box.

"Large enough where he felt he needed to pay people to help him load them onboard the trains. That's just not something you tend to see in Dallas" DART Spokesman Morgan Lyons said.

DART says the man cooperated and went with police for questioning.

Meanwhile, a bomb squad was brought in but found nothing in the items the man was carrying. Once the area was cleared by police the train service resumed.

DART says they haven’t taken any extra security measures since it was revealed Osama Bin Laden wanted to attack American trains. Still, customers should be vigilant.

"We're reminded daily that infrastructure targets around the world are targets. That's why we continue to remind customers through repeated messages on board. It’s a recorded message on board. If you see suspicious packages or if you see suspicious behavior, we want you to report it" Lyons said.

But some, like passenger Andria Delgado, feel it may be too much.

"I just think we're on edge and we need to be reasonable about it", she said.

I suspect the guy is no more dangerous than an art student in town to document an event.

Army medical examiners were suspicious about the close proximity of the three bullet holes in Pat Tillman’s forehead and tried without success to get authorities to investigate whether the former NFL player’s death amounted to a crime, according to documents obtained by The Associated Press.

“The medical evidence did not match up with the scenario as described,” a doctor who examined Tillman’s body after he was killed on the battlefield in Afghanistan in 2004 told investigators.

The doctors — whose names were blacked out — said that the bullet holes were so close together that it appeared the Army Ranger was cut down by an M-16 fired from a mere 10 yards or so away.

In April 2004, the Army reported that Tillman had been killed in action after saving dozens of comrades from an enemy ambush, an act of bravery that earned him a posthumous Silver Star. Astoundingly, almost nothing about this inspiring account was true, as his family first found out five weeks later following another official announcement. In fact, an investigation had revealed that Tillman was killed by friendly fire as members of his unit shot indiscriminately at him and a couple of other soldiers separated from their unit and believed to be guerrillas.

The issue with "lists"

You trust your safety to bureaucraps that put six-year olds on a "no fly" list?

Anonymous accusation. No explanation. No evidence. No recourse.

Imagine a court system that worked in such a way; you can't face your accuser or see the evidence against you. Just show up, get sentenced.

Later, when they come up with "no work" and "no shop" lists ('cause teh terr'izts need to eat and pay bills, too), more people will understand why it's a big deal.

Growing your own food will be deemed "suspicious activity".

9/11 Responders To Be Screened For Terrorism Ties

WASHINGTON -- A provision in the new 9/11 health bill may be adding insult to injury for people who fell sick after their service in the aftermath of the 2001 Al Qaeda attacks, The Huffington Post has learned.

The tens of thousands of cops, firefighters, construction workers and others who survived the worst terrorist assault in U.S. history and risked their lives in its wake will soon be informed that their names must be run through the FBI’s terrorism watch list, according to a letter obtained by HuffPost.

Any of the responders who are not compared to the database of suspected terrorists would be barred from getting treatment for the numerous, worsening ailments that the James Zadroga 9/11 Health And Compensation Law was passed to address.

The provision was added in an amendment by Rep. Cliff Stearns (R-Fla.) during the heated debate over the bill in the House Energy and Commerce Committee last May.
