All Hail King Barack the First

Creating any form of a democratic form of government is tough and America's Founders had it tougher than most. One must remember that what they were attempting to do hadn't ever been done before, they were essentially making it up as they went along. But one thing they were very clear about: they had no interest in being ruled by a King or any other type of autocrat. If anything, they went out of their way in ensuring that such a thing would never happen in this nation, crafting a document that was very clear and specific regarding the equal division of powers among three equal branches of government (one of which was further divided in two) and clearly specifying exactly what each branch could, and more importantly, could not do.

Historians have often argued that our first autocratic President was Abraham Lincoln, who took extraordinary measures during a time of great crisis to ensure the overall survival of the Union itself, with little regard to the potential long-term consequences of some of his decisions. However, it took another 40 years or so for Presidents to decide that they had the power to rule over the land, using their own personalities to point our nation in the direction in which they believed it should go. Theodore Roosevelt, who was soon followed by Woodrow Wilson, were both  Progressives, in the sense that they believed government was a powerful force for good and should be used to correct the wrongs that they witnessed. It could literally be argued that those two men radically altered the look of the nation, bringing in a host of new laws and ideas that still impact our lives today.

Roughly a century after Theodore Roosevelt left office, another charismatic young man seeks to re-shape the country based on his own ideas, backed up with the power of his own rhetoric. That man is Barack Obama, former Illinois state legislator and professional agitator who seems little bothered with the restrictions put into place by the very Constitution he claims to have once taught. Need powerful agency directors whom you don't want to be bothered by Congressional oversight? No problem, just about a couple of dozen "Czars" who can implement your desired changes free from Congressional authorization. Union backers facing the prospect of seeing their companies go under after years of union-led abuse? No problem, let's just buy those companies outright, then fudge the books in such a manner as to make it appear as if these were profitable deals. The list is as endless as the one containing his campaign promises.

This leads us to His majesty's latest outrage: the direct appointment of Richard Cordray as head of a newly-created Consumer Financial Protection Bureau. One moment while we leaf through the Constitution searching for the clause giving the Executive Branch the power to create such an agency...

The Cordray appointment is controversial in two regards:

First, his appointment was already blocked by the Senate, using the power exclusively granted to that segment of the Legislative Branch. Obama is blatantly circumventing the authority which is expressly granted to the Senate alone. The Executive Branch does not possess the Constitutional authority to make such appointments without consent, see Article Two, Section Two. One would think a former professor of Constitutional law might be aware of this fact.

Secondly, a so-called "recess appointment" can only be made after the Senate has been out of session for at least 10 days, while the Senate is actually still in what is known as a "pro-forma" session, which the Senate website defines as:

pro forma session - A brief meeting (sometimes only several seconds) of the Senate in which no business is conducted. It is held usually to satisfy the constitutional obligation that neither chamber can adjourn for more than three days without the consent of the other.

In other words, the Senate is still technically in session, which should negate the ability of the Executive Branch to make appointments which can only be made when Congress is in recess.

What this all boils down to is this: a vain, self-absorbed man who rose to the highest office in our nation entirely on his ability to publish allegedly ghost-written memoirs and speak beautifully while reading a teleprompter, is attempting to consolidate as much power as possible in his own hands, Constitution be <snip>ed. This president often reads flowery speeches from his teleprompter which talk about supporting Americans who "play by the rules" and "do what's right". In other words, playing by the rules is only for the little guy, not for His Majesty, King Barack the First.

President Obama used his recess appointment powers Wednesday to name a head for the controversial Consumer Financial Protection Bureau and three new members to the National Labor Relations Board — moves Republican lawmakers said amounted to an unconstitutional power grab.

The president acted just a day after the Senate held a session — breaking with at least three different precedents that said the Senate must be in recess for at least three days for the president to exercise his appointment power. Mr. Obama himself was part of two of those precedents, both during his time in the Senate and again in 2010 when one of his administration’s top constitutional lawyers made the argument for the three-day waiting period to the Supreme Court.

Mr. Obama tapped former Ohio Attorney General Richard Cordray to head the CFPB, and named three others to the labor board — all of which had been stymied by congressional Republicans who said Mr. Obama is accruing too much power to himself through those two agencies.

In strikingly sharp language, Republicans said the Senate considers itself still in session for the express purpose of blocking recess appointments, and the move threatened to become a declaration of war against Congress.

“Although the Senate is not in recess, President Obama, in an unprecedented move, has arrogantly circumvented the American people,” said Senate Minority Leader Mitch McConnell, Kentucky Republican.

GOP House Speaker John A. Boehner called the move “an extraordinary and entirely unprecedented power grab by President Obama that defies centuries of practice and the legal advice of his own Justice Department.”

“The precedent that would be set by this cavalier action would have a devastating effect on the checks and balances that are enshrined in our Constitution,” the Ohio Republican said in a statement.

The White House, though, argues Republican senators have been stonewalling his nominees for so long that Mr. Obama had no choice but to circumvent them.

The president introduced Mr. Cordray during a trip to Ohio Wednesday, telling a supportive crowd that the Senate Republicans’ ongoing blockade of his nomination “inexcusable.”

“I refuse to take ‘No’ for an answer. I’ve said before that I will continue to look for every opportunity to work with Congress to move this country forward. But when Congress refuses to act in a way that hurts our economy and puts people at risk, I have an obligation as president to do what I can without them,” Mr. Obama said.

CPFB supporters has said the lack of a top executive has blocked the fledgling agency from taking on a number of tasks in its mandate to police the financial sector and protect consumers from fraud. Mr. Cordray was accompanying the president on the trip, and briefly spoke to reporters.

He said he would begin work immediately, adding: “We’re going to begin working to expand our program to non-banks, which is an area we haven’t been able to touch until now.”

The Constitution gives the president the power to make appointments when the Senate is not in session and able to confirm them. Traditionally, that has been understood to mean when the Senate has adjourned for a recess longer than 10 days, and a Clinton administration legal opinion said a recess must be at least three days.

Mr. Obama’s own top constitutional lawyers affirmed that view in 2010 in another case involving recess appointments. Asked what the standard was for making recess appointments, then-Deputy Solicitor General Neal Katyal told the justices the administration agreed with the three-day rule.

“The recess appointment power can work in a recess. I think our office has opined the recess has to be longer than 3 days,” Mr. Katyal said

If you plan on throwing a dinner party full of VIPs, whatever you do, don’t seat Bob Woodward next to Al Gore.

In a speech at the Organization for International Investment’s annual dinner at D.C.’s Ritz-Carlton Hotel on Thursday, the famed Washington Post journalist, who helped uncover the Watergate scandal, disclosed that he doesn’t enjoy the former vice president as a tablemate.

Describing an event where he was paired up next to the monotone-talking ex-vice president, Woodward said, “Now, sitting next to Gore is taxing.”After some laughs from the crowd, Woodward continued, “In fact, it’s unpleasant.”

Woodward offered up another tidbit from the conversation with his dinner companion. The investigative reporter asked the politician, more than five years after leaving office, how much the public knows about what went on during the Clinton administration. Gore replied, “One percent.”

Woodward admitted that revelation made him feel a bit icky, saying, “I kind of died inside and have to confess to having an unclean thought.”

He then dug a little deeper, asking Gore, if the former VP were to write a memoir, how much Americans would know then. Gore retorted, “Two percent.”

A spokeswoman for Gore had no comment.

Spain election results.

After 7 years of Zapatero's socialist crap and green economic destruction of Spain,  the conservatives have been brought back to hopefully "fix" their problems.  It is a parallel template for what has been done to this country even before the current fascist greenies screwing things up even worse.  End progressivism now! The conservative opposition People's party (PP) of Mariano Rajoy have won a clear majority in Spain's general election.

With over 90% of the votes from the election counted, the centre-right PP won 186 seats compared to 154 in the last legislature, while the Socialists plummeted from 169 to 110, their worst performance ever.

Although the 56-year-old is an apostle of deficit control and liberalisation, he has been deliberately vague about his plans so as not to frighten off voters.

With yields on Spanish sovereign debt soaring to new highs at the end of last week, he takes over a country in crisis.

He will come under immediate pressure from markets to reveal exactly how he intends both to kickstart growth and cut spending. Some experts say he must find €18bn (£15.4bn) through cuts or tax hikes. Rajoy pleaded last week for markets to give him "more than half an hour", but has also said that his party already has clear plans.

PP spokeswoman Ana Mato confirmed that the party's own polling also gave them an clear majority. "The PP has won with an ample majority," she said. "Our only objective now will be to overcome unemployment and the crisis."

Rajoy is a former property registrar who held various ministerial posts in the governments of José María Aznar between 1996 and 2004.

Spaniards show little personal enthusiasm for the uncharismatic conservative, but they tired of Zapatero, who oversaw a dramatic economic slump that left growth at 0% and unemployment at 23%.

With Spain's sovereign debt yields last week approaching the levels at which Portugal and Greece needed bailouts, Socialist candidate Alfredo Pérez Rubalcaba had little chance of extending the seven-and-a-half year period of leftwing government under Zapatero.

The Socialist prime minister had brought elections forward by six months and said he would not stand again.

Zapatero stays on as caretaker prime minister for another month, however, as parliament must meet and the king has to consult political parties before a new government is formed. Parliament does not sit until 13 December.

It was not clear how the caretaker government would co-ordinate its response to the ongoing sovereign debt crisis with Rajoy's future government, though it has promised to work with the PP.

Government spokesman José Blanco has rejected calls by senior PP officials for the handover to be speeded up. "The timings and calendar are determined by law and cannot be changed," he said.

Spaniards hope the change of government will calm markets that had increased pressure on the country's debt despite Zapatero's own austerity programme, which saw civil service pay cut and pensions frozen.

Deficit spending by regional governments, which provide basic services such as education and health, has also been squeezed, sending public service trade unions out in protest.

Zapatero has also extended the retirement age and changed the constitution to allow for a long-term deficit limit to be set on the budget. Rajoy has said one of his first measures will be to set that limit.

Rajoy's promises of major reforms, more austerity and strict deficit control are in tune with market demands and with those of Germany's Angela Merkel, the European Central Bank and the European commission.

PP shadow finance minister Cristóbal Montoro has said the new government will act hard and fast, introducing reforms immediately. Rajoy must now name his future finance minister. He has said in the past that he is happy to choose someone from outside the party, so may end up naming a market-friendly technocrat.

Further spending cuts on top of those already imposed by Zapatero risk tipping the country into recession. They may also be energetically opposed by the peaceful "indignado" movement that took over city squares earlier this year.

For the first time in decades, Spaniards voted without the threat of violence from Basque separatist group Eta, which declared an end to 40 years of terrorism last month. Basque voters turned out in force and looked likely to send up to half-a-dozen avowedly separatist deputies to the new parliament.

With wintry weather poised to swoop into the cramped outdoor quarters of Occupy Wall Street protesters, it may not be long before more campers catch what's being called "Zuccotti lung."

That's what demonstrators have dubbed the sickness that seems to be spreading among them at an unpleasantly high rate these days: "It's a real thing," Willie Carey, 28, told the New York Times.

With little sleep in cold conditions, cigarettes and drinks being passed from mouth to mouth, and few opportunities to wash hands, Zuccotti Park may now just be the best place to catch respiratory viruses, norovirus (also known as the winter vomiting virus) and tuberculosis, according to one doctor.

The damp clothing and cardboard signs wet with rain are also breeding grounds for mold. Some protesters are urinating in bottles and leaving food trash discarded throughout the campground, providing further opportunities for nastiness.

“Pretty much everything here is a good way to get sick,” Salvatore Cipolla, 23, from Long Island, told the Times. “It’ll definitely thin the herd.”

Some protesters have refused free flu shots, citing a "government conspiracy," the Times said.

There is also the increased risk among the encampment of sexually transmitted diseases, said the doctor, Dr. Philip M. Tierno, Jr. of the NYU Langone Medical Center. And the site's pounding circles could lead to hearing damage.

Tierno compared conditions at the park to the pilgrimage to Mecca, in which entire groups of people have come down with respiratory infections in short period of time, and the communal compounds of the 1960s where sanitation problems and STDs cropped up.

The health department has visited the site and is monitoring.

“It should go without saying that lots of people sleeping outside in a park as we head toward winter is not an ideal situation for anyone’s health,” the department said in a statement.

David Axelrod's Pattern of Sexual Misbehavior

Herman Cain? has spent his life living and working all over the country -- Indiana, Georgia, Minnesota, Nebraska, Kansas, Washington, D.C. -- but never in Chicago.

So it's curious that all the sexual harassment allegations against Cain emanate from Chicago: home of the Daley machine and Obama consigliere David Axelrod?.

Suspicions had already fallen on Sheila O'Grady, who is close with David Axelrod and went straight from being former Chicago mayor Richard M. Daley's chief of staff to president of the Illinois Restaurant Association (IRA), as being the person who dug up Herman Cain's personnel records from the National Restaurant Association (NRA).

The Daley-controlled IRA works hand-in-glove with the NRA. And strangely enough, Cain's short, three-year tenure at the NRA is evidently the only period in his decades-long career during which he's alleged to have been a sexual predator.

After O'Grady's name surfaced in connection with the miraculous appearance of Cain's personnel files from the NRA, she issued a Clintonesque denial of any involvement in producing them -- by vigorously denying that she knew Cain when he was at the NRA. (Duh.)

And now, after a week of conservative eye-rolling over unspecified, anonymous accusations against Cain, we've suddenly got very specific sexual assault allegations from an all-new accuser out of ... Chicago.

Herman Cain has never lived in Chicago. But you know who has? David Axelrod! And guess who lived in Axelrod's very building? Right again: Cain's latest accuser, Sharon Bialek.

Bialek's accusations were certainly specific. But they also demonstrated why anonymous accusations are worthless.

Within 24 hours of Bialek's press conference, friends and acquaintances of hers stepped forward to say that she's a "gold-digger," that she was constantly in financial trouble -- having filed for personal bankruptcy twice -- and, of course, that she had lived in Axelrod's apartment building at 505 North Lake Shore Drive, where, she admits, she knew the man The New York Times calls Obama's "hired muscle."

Throw in some federal tax evasion, and she's Obama's next Cabinet pick.

The reason all this is relevant is that both Axelrod and Daley have a history of smearing political opponents by digging up claims of sexual misconduct against them.

John Brooks, Chicago's former fire commissioner, filed a lawsuit against Daley six months ago claiming Daley threatened to smear him with sexual harassment accusations if Brooks didn't resign. He resigned -- and the sexual harassment allegations were later found to be completely false.

Meanwhile, as extensively detailed in my book Guilty: Liberal 'Victims' and Their Assault on America, the only reason Obama became a U.S. senator -- allowing him to run for president -- is that David Axelrod pulled sealed divorce records out of a hat, first, against Obama's Democratic primary opponent, and then against Obama's Republican opponent.

One month before the 2004 Democratic primary for the U.S. Senate, Obama was way down in the polls, about to lose to Blair Hull, a multimillionaire securities trader.

But then The Chicago Tribune -- where Axelrod used to work -- began publishing claims that Hull's second ex-wife, Brenda Sexton, had sought an order of protection against him during their 1998 divorce proceedings.

From then until Election Day, Hull was embroiled in fighting the allegation that he was a "wife beater." He and his ex-wife eventually agreed to release their sealed divorce records. His first ex-wife, daughters and nanny defended him at a press conference, swearing he was never violent. During a Democratic debate, Hull was forced to explain that his wife kicked him and he had merely kicked her back.

Hull's substantial lead just a month before the primary collapsed with the nonstop media attention to his divorce records. Obama sailed to the front of the pack and won the primary. Hull finished third with 10 percent of the vote.

Luckily for Axelrod, Obama's opponent in the general election had also been divorced.

The Republican nominee was Jack Ryan, a graduate of Dartmouth and Harvard law and business schools, who had left his lucrative partnership at Goldman Sachs? to teach at an inner-city school on the South Side of Chicago.

But in a child custody dispute some years earlier, Ryan's ex-wife, Hollywood sex kitten Jeri Lynn Ryan?, had alleged that, while the couple was married, Jack had taken her to swingers clubs in Paris and New York.

Jack Ryan adamantly denied the allegations. In the interest of protecting their son, he also requested that the records be put permanently under seal.

Axelrod's courthouse moles obtained the "sealed" records and, in no time, they were in the hands of every political operative in Chicago. Knowing perfectly well what was in the records, Chicago Tribune attorneys flew to California and requested that the court officially "unseal" them -- over the objections of both Jack and Jeri Ryan?.

Your honor, who knows what could be in these records!

A California judge ordered them unsealed, which allowed newspapers to publish the salacious allegations, and four days later, Ryan dropped out of the race under pressure from idiot Republicans (who should be tracked down and shot).

With a last-minute replacement of Alan Keyes as Obama's Republican opponent, Obama was able to set an all-time record in an Illinois Senate election, winning with a 43 percent margin.

And that's how Obama became a senator four years after losing a congressional race to Bobby Rush?. (In a disastrous turn of events, Rush was not divorced.)

Axelrod destroyed the only two men who stood between Obama and the Senate with illicitly obtained, lurid allegations from their pasts.

In 2007, long after Obama was safely ensconced in the U.S. Senate, The New York Times reported: "The Tribune reporter who wrote the original piece (on Hull's sealed divorce records) later acknowledged in print that the Obama camp had 'worked aggressively behind the scenes' to push the story."

Some had suggested, the Times article continued, that Axelrod had "an even more significant role -- that he leaked the initial story."

This time, Obama's little helpers have not only thrown a bomb into the Republican primary, but are hoping to destroy the man who deprives the Democrats of their only argument in 2012: If you oppose Obama, you must be a racist.

Wowsie wow!!!!! The city of Baltimore, MD is cutting off the ELECTRICITY hmmmmmmmmmmmmmm.  at the OWS protest site "not intended to be a campsite"  "no permit".  Could it be the police unions want more money for this BS?  No actually it is assault, rape, grand larceny,  drug dealing,  labeled as a "public safety hazard".

Trust me the police would MUCH rather do a little overtime at Tea Party rallies.  Go ahead ask a cop where they would rather make overtime???????????????

City Cuts Power To Occupy Baltimore Site

BALTIMORE (CBS/AP) — City officials say they’re cutting power to outlets in the downtown Baltimore park where WallStreet protesters have been living for the last month.

Mayoral spokesman Ian Brennan said Wednesday that the city is taking this step to alleviate a public safety hazard at McKeldin Square near the Inner Harbor. He said a city official visited earlier this week and found fire and electrocution hazards.

Brennan added the outlets were installed so permitted groups could use electricity, but Occupy Baltimore protesters do not have a permit. He said the group is welcome to continue its protest, but the park is not meant to be a camp site.

Street lights in the square will still be lit at night, but the outlets on the poles will no longer provide electricity.

Yesterday, Mayor Stephanie Rawlings-Blake said she was concerned about reports of illegal activity at the Occupy Baltimore encampment.

The mayor said Tuesday that she worries that some protesters may be discouraging people from reporting crime to authorities.

Police are investigating a reported assault and theft at the site. A woman told police she stayed in a man’s tent Friday night and awoke to find her money gone. Police say there’s no evidence of sexual assault.

Occupy Baltimore said it takes such allegations seriously and has a zero-tolerance policy toward assault.

Rawlings-Blake said she respects protesters’ free speech rights, but the park is not for camping and should be a space everyone can enjoy.
